📜🇵🇭 HOW TO CORRECT ERRORS IN YOUR BIRTH CERTIFICATE 🇵🇭📜
Are there misspellings or wrong information in your birth certificate? Here’s what you need to know about correcting entries — whether it’s a simple typo or a serious legal matter.



🛠 TWO TYPES OF BIRTH CERTIFICATE CORRECTIONS:

1️⃣ Administrative Correction (RA 9048 as amended by RA 10172)
✔️ No court needed — You can apply at the Local Civil Registry (LCR).

📝 COVERS SIMPLE ERRORS ONLY:
Examples:
• Misspelled first name, middle name, or last name
➤ e.g. “Jhon” instead of “John”
• Wrong gender due to a clerical error
➤ e.g. Marked “Female” when obviously Male
• Day and month of birth (NOT year)
➤ e.g. “Feb 21” instead of “Jan 21”

🗂 REQUIREMENTS for Administrative Correction:
• Petition for Correction of Entry (under oath)
• Certified true copy of the birth certificate with the error
• Supporting documents:
• School records
• Baptismal certificate
• Valid ID
• Barangay certification (if needed)
• Proof of publication (for certain cases)
• Filing fee (varies by LCR; ₱1,000+)

📍Where to file:
• Local Civil Registry where the birth was recorded
• Or at the Philippine Consulate (if born abroad)



2️⃣ Judicial Correction (Rule 108, Rules of Court)
⚖️ Court petition is required — For substantial or controversial changes.

📝 USED FOR COMPLEX ISSUES:
Examples:
• Changing nationality or citizenship
• Changing legitimacy status (e.g. from “illegitimate” to “legitimate”)
• Changing the year of birth
• Changing full name (if not a clerical error)
• Correction involving identity, lineage, or parental relationships

🗂 REQUIREMENTS for Judicial Correction:
• Petition for Correction filed in the RTC (Regional Trial Court)
• Birth certificate with the error
• Affidavits, supporting documents
• Court fees
• Notice and publication as ordered by the court
• Appearance in hearings (you or your representative)

🕒 This process may take several months to a year depending on complexity and court schedule.



⚠️ REMINDER:

Not all errors can be fixed through a simple administrative process. If the correction affects your legal status, identity, or family relationships, you must go to court.
