Fostering a speedy resolution of labor management disputes, DOLE Pampanga facilitated the settlement between 4 previous employees and their employer that resulted to a P503k payment of claims yesterday, July 02.

Arising from an alleged constructive dismissal case involving 4 workers, the requesting parties proceeded to DOLE Pampanga Field Office to formally file the complaint.

The Office, thru SEnA Desk Officer Akbar O. Tumale, acted on the received request for assistance (RFA) and informed the management, as the responding party, to appear on a scheduled conference.

On July 02, after 2 conferences, both parties agreed to settle the case and that the responding party would pay employees A, B, C, and D the amount of P84,590, P112,781, P132,064, and P174,384, respectively, with an aggregate amount of P503k.

Moreover, the responding party committed to provide the request of the affected employees for the copy of their Certificate of Employment (COE) for the duration of their job in the company.

Providing an immediate response after facing sudden income loss and employment displacement, 20 construction workers-survivors from the Golden Years Construction and Steelworks Corp. received their salary after a 20-day work under the TUPAD Program of the Department.

Following the collapse of the building last May, DOLE Pampanga TUPAD and DILP team conducted a profiling among the survivors to provide them assistance through the existing DOLE programs.

During the conduct of the profiling, 20 out of the 24 survivors were present, according to their fellow workers the remaining 4 returned back to their hometown in the Bicol Region immediately following the incident.

After the conduct of profiling and assessment to the survivors, it was identified that the TUPAD Program was the most effective and immediate intervention that can be extended to them since most of them had no permanent dwelling in the province to sustain a micro-enterprise under DILP.

Among the 20 survivors, 9 were identified as residents of Pampanga, 3 from Bulacan, 1 from Tarlac while the remaining 6 were residing outside Central Luzon like Cavite, Manila, Camarines Sur, and Antique.

These survivors worked for 20 days in assisting in clean-up operations around the command center and distribution of food and water to rescuers, volunteers, and various government agencies responsible in the area from June 4 to June 23.

On July 01, the 20 survivors received their salaries amounting to P12,000 each for the 20 day work program or a total of P240,000 at DOLE Pampanga Field Office.

On June 17, Secretary Francis N. Tolentino announced that the Department ordered the Golden Years Construction and Steelworks Corp. to pay P11.7M in labor violations and penalties under the Occupational Safety and Health Standards.

Aligned with the priority of DOLE Secretary Francis N. Tolentino in equipping Filipino students with skills through youth employability programs and to provide them opportunities for financial sources while in their academic break, DOLE Pampanga conducted the simultaneous orientation among the 3,600 student-beneficiaries of SPES that ran from June 23 to 26.

The initiative was in partnership with the Provincial Government of Pampanga who would provide the 60% of the salary of the beneficiaries, while the remaining 40% would be subsidized by the Department where a total of P46M was allocated for the program.

The orientations among the beneficiaries were divided into 9 clusters and conducted in key locations like in Guagua, San Simon, Macabebe, Floridablanca, Minalin, Sta. Ana, Arayat, Magalang, Sta. Rita, Bacolor and City of San Fernando.

DOLE Pampanga staff were deployed to these orientations and discussed the objectives of the program as well as the process they would undergo and their benefits from the SPES.

SPES beneficiaries were to receive a maximum of P12,783 according to the classification of their respective municipalities and cities for the 20-day work, where they were expected to perform clerical, administrative, and community-based jobs.

Further, most of these beneficiaries were incoming college students and were expected to transition from basic education to higher education and their salaries would help them defray expenses in their academic needs.

Mayors and PESO Managers of the respective LGUs attended the events and provided inspirational messages among the beneficiaries as a way of supporting the youth in enhancing their skills and in their temporary employment.

Over the years, DOLE Pampanga had supported thousands of students thru SPES and was able to assist them to obtain their bachelorโ€™s degree where most of them landed better opportunities in their chosen careers.

Prioritizing a swift dispute resolution thru amicable settlement, an employee from a private company secured her unpaid wages amounting to P243,000 facilitated by the Department of Labor and Employment (DOLE) Pampanga Field Office under the Single-Entry Approach (SEnA) program.

The requesting party sought legal advice at DOLE Pampanga and eventually filed a Request for Assistance (RFA) for a claim against her former employer for her unpaid salaries.

Under the guidance of SEnA Desk Officer Akbar O. Tumale, Senior Labor and Employment Officer, both parties engaged in a constructive dialogue that resulted to an agreement of settling the issues raised.

In view of the companyโ€™s financial difficulties, the parties voluntarily reached a compromised agreement where the company, as the respondent, committed to release said amount in 3-month installment term.

The settlement was formalized thru a Minutes of Conference signed by both parties ensuring compliance and enforcement mechanisms through DOLE Regional Office III.

This resolution highlights the effectiveness of the SEnA program in providing workers and employers with a speedy, accessible, and non-adversarial mechanism for resolving labor disputes, while ensuring the timely delivery of workersโ€™ lawful benefits.

Yesterday, DOLE Secretary Francis Tolentino assured the public that the Department would strengthen labor law enforcement in order to protect workers.
