The 𝗚𝗼𝘃𝗲𝗿𝗻𝗺𝗲𝗻𝘁 𝗣𝗿𝗼𝗰𝘂𝗿𝗲𝗺𝗲𝗻𝘁 𝗣𝗼𝗹𝗶𝗰𝘆 𝗕𝗼𝗮𝗿𝗱–𝗧𝗲𝗰𝗵𝗻𝗶𝗰𝗮𝗹 𝗦𝘂𝗽𝗽𝗼𝗿𝘁 𝗢𝗳𝗳𝗶𝗰𝗲 (𝗚𝗣𝗣𝗕-𝗧𝗦𝗢) advises all Procuring Entities, suppliers, observers, civil society organizations, and the general public that the "𝗜𝗺𝗽𝗹𝗲𝗺𝗲𝗻𝘁𝗶𝗻𝗴 𝗥𝘂𝗹𝗲𝘀 𝗮𝗻𝗱 𝗥𝗲𝗴𝘂𝗹𝗮𝘁𝗶𝗼𝗻𝘀 𝗼𝗳 𝗥𝗲𝗽𝘂𝗯𝗹𝗶𝗰 𝗔𝗰𝘁 𝗡𝗼. 𝟭𝟮𝟬𝟬𝟵 (𝟭𝘀𝘁 𝗘𝗱𝗶𝘁𝗶𝗼𝗻, 𝗮𝘀 𝗼𝗳 𝟯𝟭 𝗠𝗮𝗿𝗰𝗵 𝟮𝟬𝟮𝟲)" 𝗽𝗿𝗲𝘃𝗶𝗼𝘂𝘀𝗹𝘆 𝗶𝘀𝘀𝘂𝗲𝗱 𝗯𝘆 𝘁𝗵𝗲 𝗚𝗣𝗣𝗕-𝗧𝗦𝗢 𝗮𝗻𝗱 𝗽𝗼𝘀𝘁𝗲𝗱 𝗼𝗻 𝗶𝘁𝘀 𝘄𝗲𝗯𝘀𝗶𝘁𝗲 𝗵𝗮𝘀 𝗯𝗲𝗲𝗻 𝘄𝗶𝘁𝗵𝗱𝗿𝗮𝘄𝗻 𝗮𝗻𝗱 𝘀𝗵𝗼𝘂𝗹𝗱 𝗻𝗼 𝗹𝗼𝗻𝗴𝗲𝗿 𝗯𝗲 𝘂𝘀𝗲𝗱 𝗮𝘀 𝗿𝗲𝗳𝗲𝗿𝗲𝗻𝗰𝗲.

Accordingly, all concerned are reminded to use and cite only the Implementing Rules and Regulations (IRR) of Republic Act (RA) No. 12009 approved by the GPPB through its Resolution No. 02-2025 dated 04 February 2025, published in the Official Gazette on 10 February 2025, and effective 25 February 2025. All concerned agencies and stakeholders are likewise advised to refrain from citing, relying upon, reproducing, or disseminating the withdrawn GPPB-TSO-issued "Implementing Rules and Regulations of Republic Act No. 12009 (1st Edition, as of 31 March 2026)" or any other unofficial version of the IRR.

This Advisory is being issued to ensure the correct implementation of Republic Act No. 12009 through the GPPB-approved IRR.

𝗣𝗮𝗽𝗮 𝗕𝗶𝗹𝗹𝘆 𝗔𝘀𝗸𝘀: 𝗔𝗻𝗼 𝗻𝗴𝗮 𝗯𝗮 𝗮𝗻𝗴 𝗰𝗼𝗻𝘁𝗿𝗮𝗰𝘁 𝘀𝗽𝗹𝗶𝘁𝘁𝗶𝗻𝗴 𝘀𝗮 𝗶𝗹𝗮𝗹𝗶𝗺 𝗻𝗴 𝗡𝗚𝗣𝗔?

Under the New Government Procurement Act, competitive bidding is no longer the default mode of procurement. Procuring Entities are now expected to choose the most appropriate mode of procurement based on the nature, value, complexity, urgency, and market conditions of the requirement.

But this flexibility does not mean contracts may be divided just to avoid the rules.

Contract splitting happens when a procurement requirement is artificially divided into smaller parts to avoid thresholds, approvals, competition requirements, or the proper mode of procurement.

The rule remains clear: procurement planning must be strategic, transparent, and justified. The chosen mode of procurement must support value for money, efficiency, accountability, and fair competition.
