BETARANONG ICC LAWYER, SINABING DAPAT MAGDESISYON MUNA ANG KORTE SUPREMA NG PILIPINAS BAGO ISUKO SI SEN. BATO
Naniniwala ang ICC lawyer na si Michael Karnavas na kinakailangang magdesisyon ang Korte Suprema sa isyung kinakaharap ni Senador Ronald "Bato" dela Rosa sa gitna ng ICC warrant na kinakaharap nito.
Sa kanyang komentaryo, sinabi ni Karnavas na habang tapos na ang isyu ng warrant ni Dela Rosa sa ICC dahil sa naumpisahan na nila ang preliminary examination bago pa man umalis ang Pilipinas sa Rome Statute, hindi pa umano ito maituturing na tapos sa Pilipinas.
Ayon kay Karnavas, ang dapat masagot na katanungan sa isyung kinakaharap ni Dela Rosa ay kung may otoridad pa ba ang Pilipinas na makipagtulungan sa ICC kahit na nag-withdraw na sila sa Rome Statute.
Masasagot lamang umano ito sa pamamagitan ng desisyon sa Korte Suprema.
"In my view, the Supreme Court should resolve that question before any surrender occurs. This is not an argument for impunity, nor is it an argument against international criminal justice. It is an argument for constitutional adjudication and the rule of law," ani Karnavas.
"The legal question is serious. The constitutional implications are significant. The political consequences within the Philippines are obvious. Under these circumstances, allowing the Supreme Court to address the matter directly would strengthen democratic institutions rather than weaken them," dagdag pa niya.
Sa pamamagitan rin umano ng desisyon ng Korte Suprema ay matatanggal ang bahid politika ng ICC warrant.
"At present, decisions about cooperation with ICC arrest warrants risk being framed primarily as political choices for the executive branch to make. And herein lies the rub. Supreme Court review would instead return the matter to where it properly belongs: within legal institutions that apply constitutional and statutory analysis through transparent judicial procedures," aniya.
"Whatever the Supreme Court ultimately decides, the result would carry greater democratic legitimacy and acceptance because it would stem from constitutional adjudication rather than from perceived executive expediency or political pressure," dagdag pa niya.
