TEMPORARY PROTECTION ORDER (TPO) UNDER Republic Act No. 9262 – WHEN AND HOW YOU CAN USE IT

If you are experiencing abuse from a partner, you do not have to wait for a full-blown case before being protected. The law allows the court to issue a Temporary Protection Order (TPO) immediately, even on the same day of filing.

A TPO may be availed of in cases of violence against women and their children (VAWC). This covers not just physical violence, but also psychological abuse, threats, harassment, stalking, economic abuse, and even online or cyber harassment committed by a husband, ex-partner, boyfriend, or anyone with whom the woman has or had a relationship.

When can a TPO be issued?
The court may grant a TPO when there is a showing that violence has been committed, is being committed, or there is a real threat that it will be committed. You do not need to prove the case fully at this stage. It is enough that the application and supporting documents show urgency and the need for protection.

Common grounds include situations where the respondent:

* Inflicts or threatens physical harm
* Causes mental or emotional suffering (e.g., repeated harassment, humiliation, threats, infidelity used to psychologically abuse)
* Engages in stalking or persistent unwanted contact
* Controls or withholds financial support
* Uses threats, intimidation, or coercion
* Commits acts of cyber harassment, including threats to expose private photos or information

A TPO is issued ex parte, meaning without prior notice to the respondent, precisely to prevent further harm.

Once issued, it is immediately enforceable. The court may order the respondent to stay away from the victim, leave the residence, cease communication, and stop all forms of abuse. It may also include temporary custody of children, support, and protection over property.

The TPO is effective for 30 days, during which the court will conduct a hearing to determine whether a Permanent Protection Order (PPO) should be issued.

Most importantly, a TPO has teeth. Violation of a TPO is a criminal offense, which can lead to arrest and prosecution.

The law is clear: protection comes first, trial comes later. If there is danger or even a real threat of harm, the courts can step in immediately.

QUESTION NO. 706 - MAAARI BANG GUMAMIT NG SHARI'AH DIVORCE SA ILALIM NG BATAS ISLAM ANG MGA MAG-ASAWANG KINASAL SA CHRISTIAN/CATHOLIC RITES O COURT WEDDING, KUNG SILA AY NAGBALIK-ISLAM (CONVERTED TO MUSLIMS)?

❗ Ayon sa People vs. Malaki:

While government agencies implement energy conservation measures, essential services for women and girls must proceed without interruption, the Philippine Commission on Women (PCW) advises government entities.

In Advisory No. 2026-001, the PCW outlined critical Gender and Development (GAD) programs that must be protected from reduction or deprioritization during the energy crisis. Agencies must maintain the continuous operation of life-saving interventions, including Violence Against Women (VAW) desk operations, case management, legal and psychosocial support, and maternal and reproductive health services. The PCW warns that disrupting these mandated services could expose victims to further harm and result in adverse health outcomes.
