مذكرة حول إنفاذ التزامات الاتحاد الأوروبي بموجب القانون الدولي في مواجهة الاستيطان الاستعماري الإسرائيلي وتسليح ميليشيات المستوطنين في الأرض الفلسطينية المحتلة

تحية طيبة وبعد،
يتشرف الائتلاف الأهلي النسوي الفلسطيني لتطبيق قرار مجلس الأمن 1325 بأن يرفع إلى مقام مؤسسات الاتحاد الأوروبي هذه المذكرة، في ظل التصعيد غير المسبوق الذي تشهده الأرض الفلسطينية المحتلة، وفي ضوء التطورات القانونية الدولية الأخيرة، وفي مقدمتها الرأي الاستشاري لمحكمة العدل الدولية الذي أكد عدم قانونية استمرار الاحتلال الإسرائيلي للأرض الفلسطينية وما يترتب على ذلك من التزامات قانونية على جميع الدول، ومن ضمنها عدم الاعتراف بالوضع غير المشروع الناشئ عن الاحتلال، وعدم تقديم أي عون أو مساعدة تسهم في استمراره، واتخاذ التدابير اللازمة لضمان احترام القانون الدولي. وانطلاقًا من المادة (21) من معاهدة الاتحاد الأوروبي، التي تجعل احترام القانون الدولي وحقوق الإنسان وسيادة القانون أساسًا لسياسته الخارجية، فإننا نتطلع إلى أن يترجم الاتحاد الأوروبي هذه المبادئ إلى إجراءات عملية تتناسب مع جسامة الانتهاكات المرتكبة في الأرض الفلسطينية المحتلة.
تشهد الأرض الفلسطينية المحتلة تصاعدا غير مسبوق في المشروع الاستيطاني الاستعماري الإسرائيلي، يتمثل في التوسع المنهجي للمستوطنات القائمة وبناء أخرى جديدة، وتسريع الضم الفعلي للأرض الفلسطينية، وتسليح الجماعات الاستيطانية المتطرفة، بما فيها ما يعرف بـ”فتيان التلال”، وتوفير الغطاء الرسمي والسياسي والعسكري لها لارتكاب اعتداءات منظمة ضد الفلسطينيين والفلسطينيات. ولم يعد عنف المستوطنين مجرد أعمال فردية، بل تحول إلى سياسة دولة تهدف إلى فرض وقائع جديدة بالقوة وتقويض حق الشعب الفلسطيني، غير القابل للتصرف، في الحرية وتقرير المصير.
وتشكل هذه السياسات انتهاكًا جسيمًا للقانون الدولي الإنساني، ولا سيما اتفاقية جنيف الرابعة، وانتهاكًا للقواعد الآمرة في القانون الدولي التي تحظر الاستيلاء على الأراضي بالقوة ونقل سكان دولة الاحتلال إليها. كما تتعارض بصورة مباشرة مع قرارات مجلس الأمن، ولا سيما القرارات 242 (1967)، و446 (1979)، و465 (1980)، و2334 (2016)، التي أكدت عدم شرعية المستوطنات الإسرائيلية، ودعت جميع الدول إلى التمييز في تعاملاتها بين دولة إسرائيل والأرض الفلسطينية المحتلة، بما يحول دون الإسهام، بصورة مباشرة أو غير مباشرة، في استدامة المشروع الاستيطاني الذي ينتهك القانون الدولي.
إن قيام حكومة الاحتلال بتسليح المستوطنين وتحويلهم إلى ميليشيات بلباس مدني، تمارس العنف المنظم ضد الفلسطينيين والفلسطينيات، يشكل تصعيدًا خطيرًا لا يهدد الشعب الفلسطيني وحده، بل يقوض أسس النظام القانوني الدولي، ويعرض السلم والأمن الإقليميين والدوليين لمخاطر متزايدة، ويكرس سياسة الإفلات من العقاب، بما يتعارض مع مقاصد ومبادئ ميثاق الأمم المتحدة.
كما أن هذه الممارسات تقوض بصورة مباشرة أجندة المرأة والسلام والأمن التي أرسى دعائمها قرار مجلس الأمن 1325 والقرارات اللاحقة، والتي تقوم على الوقاية من النزاعات، وحماية النساء، وضمان مشاركتهن الكاملة والمتساوية في صنع السلام، ومعالجة الأسباب الجذرية للنزاعات. وفي الحالة الفلسطينية، لا يمكن تحقيق هذه الأهداف في ظل استمرار الاحتلال والاستيطان والعنف المنظم ضد الشعب الفلسطيني بكافة مكوناته، إذ أن إنهاء الاحتلال، وضمان المساءلة، واحترام حق الشعب الفلسطيني في تقرير مصيره، تمثل، مجتمعةً، شروطًا أساسية لتحقيق سلام عادل ودائم قائم على العدالة وسيادة القانون.
إن القضية المطروحة أمام الاتحاد الأوروبي اليوم لا تتعلق بحقوق الشعب الفلسطيني فحسب، وإنما تتعلق أيضًا بمستقبل النظام الدولي القائم على قواعد القانون. فالتغاضي عن الاستيطان الاستعماري، وتسليح الجماعات الاستيطانية المتطرفة، والاستيلاء على الأراضي بالقوة، يهدد المبادئ الأساسية التي قام عليها النظام الدولي، وفي مقدمتها عدم جواز السيطرة على الأراضي بالقوة، وحق الشعوب في تقرير مصيرها، وواجب مساءلة مرتكبي الانتهاكات الجسيمة للقانون الدولي. كما أن استمرار التعامل الانتقائي مع قواعد القانون الدولي، واعتماد معايير مزدوجة في تطبيقها، لا يقوض فقط حقوق الشعب الفلسطيني، بل يضعف أيضًا مصداقية النظام القانوني الدولي، ويشجع على الإفلات من العقاب، ويقوض الثقة العالمية بسيادة القانون.
وانطلاقًا من هذه الاعتبارات القانونية، يدعو الائتلاف الأهلي النسوي الفلسطيني لتطبيق قرار مجلس الأمن 1325، مؤسسات الاتحاد الأوروبي إلى الوفاء بالتزاماتها القانونية من خلال الانتقال من سياسة الإدانة إلى سياسة المساءلة الفعلية، وفرض عقوبات محددة وفعالة على المسؤولين عن المشروع الاستيطاني، وعلى الأفراد والكيانات الضالعة في تمويل أو تسليح أو دعم الجماعات الاستيطانية المسلحة، بما فيها “فتيان التلال”، والتي صنفها الاتحاد الأوروبي نفسه كحركة إرهابية، وضمان التنفيذ الكامل لقرار مجلس الأمن 2334، بما يشمل الامتناع عن أي دعم اقتصادي أو مالي أو تجاري أو تقني يسهم بصورة مباشرة أو غير مباشرة في ترسيخ المستوطنات أو استدامة الاحتلال، ومراجعة اتفاقية الشراكة بين الاتحاد الأوروبي وإسرائيل وربط أي امتيازات أو تعاون مستقبلي باحترام إسرائيل لالتزاماتها بموجب القانون الدولي والقانون الدولي الإنساني، ودعم آليات المساءلة الدولية، بما في ذلك المحكمة الجنائية الدولية وآليات الأمم المتحدة ذات الصلة، بما يضمن عدم إفلات مرتكبي الجرائم الدولية من العقاب، واتخاذ إجراءات عملية لتوفير الحماية للفلسطينيين والفلسطينيات، ولا سيما النساء والفتيات والمدافعات عن حقوق الإنسان في المناطق المستهدفة بالاستيطان والمعرضة لعنف المستوطنين، انسجامًا مع التزامات الاتحاد الأوروبي في إطار أجندة المرأة والسلام والأمن.
إن حماية النظام القانوني الدولي لا تتحقق بالإدانة اللفظية وحدها، وإنما بإعمال قواعد القانون الدولي بصورة متسقة ودون انتقائية أو ازدواجية في المعايير. وإن إنهاء الاحتلال الإسرائيلي، وتفكيك المشروع الاستيطاني الاستعماري، وضمان مساءلة مرتكبي الانتهاكات، واحترام حق الشعب الفلسطيني في الحرية وتقرير المصير، تمثل جميعها متطلبات قانونية وأخلاقية وسياسية لتحقيق سلام عادل ودائم، لأن السلام الحقيقي لا يمكن أن يقوم إلا على إنهاء الاحتلال، وإعمال العدالة، واحترام القانون الدولي، بما يعزز السلم والأمن الإقليميين والدوليين ويحافظ على مصداقية النظام الدولي القائم على سيادة القانون.

Memorandum on the Enforcement of the European Union’s Obligations under International Law in Response to Israeli Colonial Settlement Expansion and the Arming of Settler Militias in the Occupied Palestinian Territory

Excellencies, Honorable Members,
Palestinian Women Civil Coalition for the Implementation of UNSCR 1325 has the honor of submitting this memorandum to the esteemed institutions of the European Union in light of the unprecedented escalation unfolding across the Occupied Palestinian Territory, and in view of recent developments in international law, foremost among them the Advisory Opinion of the International Court of Justice. That Opinion affirmed the unlawfulness of Israel’s continued occupation of the Palestinian Territory and clarified the legal obligations arising for all States, including the duty not to recognize as lawful the illegal situation resulting from the occupation, not to render aid or assistance that contributes to its maintenance, and to take appropriate measures to ensure respect for international law.
In accordance with Article 21 of the Treaty on European Union, which establishes respect for international law, human rights, and the rule of law as guiding principles of the Union’s external policy, we look to the European Union to translate these principles into meaningful and concrete measures commensurate with the gravity of the violations being committed in the Occupied Palestinian Territory.
Occupied Palestinian Territory is witnessing an unprecedented escalation of Israel’s colonial settlement enterprise, marked by the systematic expansion of the exiting settlements and building new ones, the accelerated de facto annexation of Palestinian land, the arming of extremist settler groups—including the so-called “Hilltop Youth” (which was classified by the EU as a Terrorist Movement)—and the provision of official political, military, and institutional support that enables these groups to carry out organized attacks against Palestinian men and women. Settler violence can no longer be dismissed as isolated acts committed by individuals; it has become an instrument of state policy aimed at imposing new realities by force and undermining the Palestinian people’s inalienable right to freedom and self-determination.
These policies constitute serious violations of international humanitarian law, particularly the Fourth Geneva Convention, as well as breaches of peremptory norms of international law prohibiting the acquisition of territory by force and the transfer of the occupying power’s civilian population into occupied territory. They also stand in direct contradiction to United Nations Security Council resolutions, in particular Resolutions 242 (1967), 446 (1979), 465 (1980), and 2334 (2016), all of which reaffirm the illegality of Israeli settlements and call upon all States to distinguish, in their dealings, between the State of Israel and the Occupied Palestinian Territory, thereby ensuring that they do not contribute, directly or indirectly, to the maintenance or expansion of the unlawful settlement enterprise.
The Israeli government's policy of arming settlers and effectively transforming them into civilian militias that carry out organized violence against Palestinians represents a dangerous escalation. It not only threatens the Palestinian people, but also undermines the very foundations of the international legal order, places regional and international peace and security at increasing risk, and entrenches a culture of impunity that runs counter to the purposes and principles of the Charter of the United Nations.
These practices also directly undermine the Women, Peace and Security agenda established by United Nations Security Council Resolution 1325 and subsequent resolutions. This agenda is founded on the prevention of conflict, the protection of women, the full, equal, and meaningful participation of women in peacebuilding and decision-making, and addressing the root causes of conflict. In the Palestinian context, these objectives cannot be achieved while occupation, settlement expansion, and systematic violence against the Palestinian people continue. Ending the occupation, ensuring accountability, and respecting the Palestinian people's right to self-determination are indispensable prerequisites for achieving a just and lasting peace founded on justice and the rule of law.
The issue before the European Union today extends beyond the rights of the Palestinian people; it also concerns the future of the international rules-based order itself. Turning a blind eye to colonial settlement expansion, the arming of extremist settler groups, and the acquisition of territory by force threatens the fundamental principles upon which that order is built, foremost among them the prohibition on the acquisition of territory by force, the right of peoples to self-determination, and the obligation to hold perpetrators of serious violations of international law accountable. Continued selective application of international law and the use of double standards not only undermine the rights of the Palestinian people, but also weaken the credibility of the international legal system, encourage impunity, and erode global confidence in the rule of law.
