Management of Condominium Developments

There have been recent media reports about a case involving a condominium development in Geylang where certain by-laws made by the Management Corporation Strata Title (MCST) sparked disagreements between the management council and some owners (also known as subsidiary proprietors or SPs). BCA would like to share some information about the management of strata-titled properties to provide a clearer understanding of the framework in place.

MCSTs are the governing bodies of strata-titled private properties such as condominiums. In such developments, owners or SPs own their individual units while collectively sharing ownership of - and responsibility for - the common property. Day-to-day management of the MCST is overseen by a management council - an elected body comprising SPs.

The Building (Strata Management) Act, or B(SM)A, provides a legal framework that empowers an MCST, which comprises all SPs, to decide how best to manage, maintain or improve the common property of the estate. MCSTs may make by-laws to regulate the management and use of common property within the development. However, such by-laws cannot restrict an SP’s right to transfer, lease, mortgage or otherwise deal with his property, as provided under section 32(9)(a) of the B(SM)A.

If SPs wish to amend or repeal enacted by-laws, they may do so by tabling a motion at the MCST’s Annual General Meeting (AGM) or an Extraordinary General Meeting (EOGM).

If there are disputes pertaining to the validity of the MCST’s enacted by-laws, SPs may apply to the Strata Titles Boards (STB) for resolution. The STB is a quasi-judicial tribunal empowered under the B(SM)A to adjudicate disputes in MCST developments, including disputes over the validity of by-laws.

Here's a friendly reminder to observe the safe use of escalators and lifts this June holiday 👇

✅ Hold the handrail and stand within the yellow lines.
✅ Young children should always be accompanied and closely supervised by an adult.
✅ Move away promptly from the landing area after alighting.
✅ If you're using a trolley, pram, luggage or carrying bulky items, take the lift instead.
