It is true that Meles had scored agreeable macroeconomic records as well as achieved noteworthy achievements in his other innovative endeavors, and socially uplifting measures like setting up the institutional mechanisms to fight violence against women and so on.

However, a rigorous examination of the institutional apparatus established during his tenure reveals a stark counter-narrative to these acclaimed success records and personal leadership qualities.

​By analyzing the legal, institutional, and human dimensions of Meles Zenawi's administration, this chapter deconstructs the narratives of institutional reform under the Ethiopian People's Revolutionary Democratic Front (EPRDF).

The author here shows 'the other side of the story': a regime defined by institutionalized dualism, the instrumentalization of the judiciary, and the systematic suppression of civil liberties.

​De jure, the cornerstone of Meles Zenawi’s institutional legacy — the 1995 Constitution of the Federal Democratic Republic of Ethiopia (FDRE)—explicitly guarantees judicial independence under Articles 78 and 79, stipulating that courts shall remain free from governmental interference.

​De facto, under Meles’s governance, this principle underwent a systematic inversion. Rather than maintaining the blindfold of impartiality, the legal apparatus was stripped of its neutrality, enabling the state to selectively protect or target individuals based on political alignment.

🔹️​The Dual State (Otto Kirchheimer / Ernst Fraenkel): In Political Justice: The Use of Legal Procedure for Political Ends, jurist Otto Kirchheimer illustrated how authoritarian regimes construct a legal framework with two distinct functions.

The system operates with hyper-efficient precision when prosecuting and neutralizing political adversaries, yet remains paralyzed and unresponsive when addressing abuses committed by state actors or regime loyalists.

​Applying these analytical models to the Meles era reveals clear structural parallels:

The administration routinely enacted statutes designed to isolate political opponents while insulating the executive branch.

A key example was the strategic alteration of bail conditions for corruption charges, specifically tailored to enable prolonged detention without trial — exemplified by the high-profile prosecution of former Defense Minister Siye Abraha.

Subsequently, hyper-broad anti-terrorism proclamations were drafted in terms that effectively criminalized peaceful dissent, investigative journalism, and human rights advocacy.

Key regulatory and oversight bodies, such as the Federal Ethics and Anti-Corruption Commission (FEACC) and national security organs, were made directly answerable to the Prime Minister’s office.

​"In the aftermath of the 1997 election near Sidist Kilo, Agazi forces shot and killed a young man at his doorstep. Hearing the gunfire, his mother rushed out to find her son's body... As she confronted the armed soldiers in unbearable grief, an officer fired his weapon, killing her directly over her child's co**se. The tragedy did not end there. When neighbors erected a mourning tent (denkwan) to comfort the family, security forces returned, forbade public weeping, and forcibly dismantled the tent."

By prohibiting public mourning and dismantling funeral structures, the state sought to suppress the visual evidence of its own violence. In this framework, collective grief was reclassified as an act of political defiance that had to be contained and penalized.

♦️ Comparative Overview: Structural Governance Paradigms

​Under a Standard Democratic Framework, the primary role of law is to protect individual rights and limit the power of the state. In contrast, the Meles Zenawi Model uses the law primarily to protect executive power and suppress political opposition.

​This stark divergence extends to the accountability of security forces. While a standard democratic system subjects security forces to independent judicial review and external oversight, the Meles Zenawi model grants them, effectively, institutional immunity for actions taken against citizens.

​A similar contrast appears in the right to public assembly. Standard democracies constitutionally protect and facilitate peaceful public gatherings, peaceful demonstrations and freedoms of association — and so does Articles 30 and 31 of the 1995 FDRE Constitution — whereas the Meles Zenawi model categorizes such assemblies and demonstrations as security threats and meets them with lethal force.

​Finally, the two paradigms handle communal and cultural rights in fundamentally different ways. A standard democratic framework respects the sanctity of life, family, and mourning. Under the Meles Zenawi model, however, public grief is considered as a threat to power, to the point where funeral tents were forcibly removed by state authorities.

🪩 Pillar 4: The Paradox of the "New King" — Cyclical Autocracy in Modern Ethiopian History

In a highly centralized, intelligence-driven state like Ethiopia where executive authority was, and still is, concentrated within the Office of the Prime Minister, the systematic deployment of legal coercion and security force intervention was not an administrative oversight; it was a foundational instrument of statecraft put to force by a calculated choice.

🪩 ​Conclusion: The Structural Imperative for Institutional Reform

​The political legacy of Meles Zenawi cannot be evaluated solely through macroeconomic indices or infrastructure outputs.

A comprehensive historical assessment must reckon with its structural legal and human outcomes: the institutionalization of a selective justice system that insulated state elites while curtailing civil liberties.

​By unbinding the eyes of Lady Justice, the regime adapted the legal system into a tool of executive power.

Pointing out these structural realities, however, does not imply that Meles was the sole actor operating without the consensus of his ruling coalition, nor does it suggest that post-Meles administrations have automatically achieved democratic governance.

Rather, it underscores that just as Meles left behind enduring administrative legacies, these institutional patterns persist as governance templates utilized by subsequent authority figures in Ethiopia.

​Understanding these dynamics is vital for establishing lasting democratic norms.

The primary challenge facing Ethiopia is not merely preventing the emergence of individual autocratic figures, but constructing robust, enduring institutions capable of guaranteeing justice, rule of law, and civil protection regardless of who holds executive power.

​Achieving true political transformation requires interrupting this historical cycle — moving beyond the periodic arrival of a "new king" to establish an independent judiciary, enforce equal protection under the law, and uphold human dignity for all citizens.
