New York Association on Independent Living The New York Association on Independent Living (NYAIL) is a statewide membership organization of ILCs

NYAIL provides programs in three interlocking areas: public policy and systems change, technical assistance and membership programs to strengthen New York State's Independent Living Centers, and public education about Independent Living and the services and supports needed by people with disabilities to live in the community. NYAIL seeks in all its activities to remove barriers to the independence, inclusion, and integration of people with disabilities in New York. Independent Living Centers are unique disability-led, cross-disability, locally administered not-for-profit organizations, providing advocacy and supports to assist people with disabilities of all ages to live independently and fully integrated in their communities. ILCs have served as the voice of the disability rights movement in New York since its inception more than two decades ago. We assist individuals in navigating complex service systems and advocate to ensure access to their chosen services and supports. Core programs include information and referral services, peer counseling, individual and systems advocacy, and independent living skills training. Other services vary from center to center but generally include: assistance with housing, education, employment, medical needs and personal attendant services. NYAIL works with ILCs to ensure the rights of all individuals with disabilities are protected, through individual advocacy, legislative and administrative systemic advocacy, grassroots organizing and, when necessary, direct action aimed at focusing the attention of decision-makers on the voice of people with disabilities who are impacted by their decisions.

This is a very disappointing ruling. We will be advocating closely with our federal partners to do everything possible to make sure people with disabilities can remain in the community and have the same long-standing protections before this ruling happened on September 23. 

NCIL Statement on Texas v. Kennedy Order Rescinding Community Integration Provisions of Section 504 Regulations

Dear Independent Living Community,

Yesterday afternoon, the federal judge in the ongoing case of Texas v. Kennedy issued a ruling.

The order approved by the judge was filed as counsel by the Department of Justice (DOJ) on behalf of the Department of Health and Human Services and the states of Texas, Florida, Alaska, Louisiana, and Montana. It affects only certain parts of the 2024 rule. The case is now closed.

This order rescinds the regulations that enforce the community integration provisions of Section 504. This applies to all states, not just the states that sued. States may now choose not to enforce community integration.

However, Section 504, the Americans with Disabilities Act, and the Supreme Court’s Olmstead v. L.C. decision remain in place. We continue to have the legal right to community integration and to receive services in the least restrictive setting of our choice.

The Statewide Systems Advocacy Network (SSAN) supports the Independent Living movement by helping build local partnerships and coalitions focused on community education and issues impacting people with disabilities.

Through SSAN, advocates and Independent Living Centers across New York State can strengthen community connections, increase awareness of Independent Living, and help create positive systems change in their communities.

Yesterday at the 2026 NYS Disaster Preparedness Commission Conference, our director Lindsay had the privilege of co-presenting alongside David Whalen, Special Assistant at the NYS Division of Homeland Security & Emergency Services.

Our session focused on inclusive planning and the vital role Independent Living Centers play before, during, and after emergencies. We emphasized ensuring that individuals with disabilities' needs are fully included in disaster preparedness plans, emergency responses, and the recovery process.

Did you know that many independent living centers are accepting donated items for loan closets?

This week, I was happy to donate some of my father's lightly used medical equipment to the Independent Living Center of the Hudson Valley loan closet. People rely on loan closets to be able to live with dignity and stay safe at home.

You should always call ahead to make sure the loan closet has space before bringing items.

We stand in fierce opposition to the Department of Justice stripping community integration out of Section 504 of the Rehab Act. We will share action alerts in the coming days.

Defend Community Integration Coalition Statement on Texas v. Kennedy Proposed Joint Resolution

The Defend Community Integration Coalition (DCIC) strongly condemns the recent proposed joint resolution filed August 31 in the ongoing case Texas v. Kennedy. The proposed resolution aims to strike down the 2024 community integration regulations under Section 504 of the Rehabilitation Act of 1973. This action flies in the face of decades of judicial precedent and Congressional intent to ensure that community integration remains a civil right for all people with disabilities.

As national disability rights leaders and allies, we have worked hard for decades to advance community integration as a foundational civil right for people with disabilities. We condemn any attacks aimed at undoing this work led by and for people with disabilities.

For people with disabilities, there is no right more foundational than the right to make our own choices. Far too often, we find ourselves in the position where others decide our lives for us. It takes a lot to ensure that the choices we have are real choices. It has taken years to build the supports we need to go to school, work, eat, stay housed, and raise our children.

As humans, we deserve the security of knowing that we have what we need to live our lives.

Life is not just about getting three square meals a day and getting our meds on time. It is about growing, working, loving, dreaming, failing and reaching our potential. It is about deciding when to get up, when to go out, what to eat, and with whom to live. It is hard to do these things when we are forced to stay in congregate settings where we have no say over most aspects of our lives.

Disabled people are survivors. We are spouses, parents, siblings, classmates, colleagues, and neighbors. Most of all, we are Americans determined to fight back against ideas and actions that take away our dignity and roll back years of hard-fought progress and rights.

As a coalition we will continue to work together and fight for the full realization of the community integration mandate. Community integration of people with disabilities is non-negotiable.

This is a monumental fight. In a moment like this, we need to join forces and work collectively. We are stronger together.
