Last week we asked the State of New Mexico key questions about Project Jupiter’s water use. Here is what we heard back. We appreciate the State’s response regarding the data center’s water use, but are deeply troubled to learn that:
1. More than 30 protests to the emergency well permit have been filed and have not yet been adjudicated;
2. To date, no formal hearings appear to have been held regarding these protests;
3. No other water permits have been filed to address the long-term operational needs of the project, and no clear and consistent information has been provided to the public regarding water use of the project post-construction.
These issues raise serious concerns about the transparency of the project’s water requirements, potential adverse impacts to other water users, whether state requirements have been met in permitting and adjudicating protests, the long-term operational impacts of the project, and whether there is sufficient water available to meet these needs.
For these reasons and more, we believe the state must conduct a thorough review and adjudication of the project’s current and proposed water use before further proceeding—including consultation with New Mexico’s Tribal Nations, acequias, and senior water users. Too much is at stake for the future of our state.
