I had a request to repost.
LET’S TALK WEDDINGS
with so many questions about the process I thought I might help.
1. Marriage License (Clerk of Courts Office - you need birth certificates and government issued picture ID yes both parties must be there unless you have a notarized document - approx $26) Call Parish Clerks office if you have questions.
2. Make an appointment with whom you choose to do your ceremony - I can only speak for myself. So any information here is about how I do a ceremony.
3. Yes, I can waive the 24 hour waiting period
4. Yes, I do everything from very formal weddings to simple casual.
5. Yes, I will go to your venue of choice within a reasonable distance.
6. Yes, I do weddings in my office.

7. You have full control of how you want your vows and ceremony. It’s your day, do it your way.
8. You will need two witnesses but you are welcome to invite as many guest as you like.
9. It’s not very ethical to talk cost but I will.
Again, this is my charges, not everyone is the same.

At Your Venue - $100 -$150 depends on mileage
Active Military - $25 (at my office)
9. After the ceremony, documents are signed, I return 2-copies and you return 1-copy to the Clerk of Court office. They will certify your copy. This is the copy you use for all legal records.

Press Release

All Louisiana Justice of the Peace Courts have been ordered to continue the suspension of their operation canceling all civil trials, hearings and court appearances until Friday, June 5, 2020 in compliance with the Louisiana Governor’s State of Emergency for COVID-19 Proclamations and Louisiana Supreme Court Orders. Further all civil legal deadlines, including prescription, are also suspended until Friday, June 5, 2020. These orders and deadlines are subject to change at any time. All parties will receive appropriate legal notice of their new court appearance dates.

Parties are currently allowed to file civil suits, eviction cases, pleadings and answers. Service may be attempted. Parties filing eviction cases before Friday, June 5, 2020 with hearings scheduled on or after Monday, June 5, 2020 may incur additional court costs if revised orders extending the court’s suspension are received.

Landlords attempting to exercise their rights to evict tenants are required to comply with the new legal constraints
as mandated under the Federal CARES Act. Landlords and tenants should review the provisions of the CARES Act. Prior to filing their case Landlords must determine and acknowledge if their property is covered under the act. Properties federally subsidized as well as properties with mortgages owned or secured through a federal program prevents a landlord from evicting a tenant for non payment of rent and fees during the period from March 27, 2020 through July 25, 2020 followed by a 30 day notice.

During this time it is not an opportunity for tenants to avoid paying rent nor give landlords a chance to repossess their property.

These orders are necessary to protect the health and safety of the public in line with the best guidance and direction from the White House, the Governor, the Centers for Disease Control, and state health officials.

As a Justice of the Peace - I’ve received many calls from couples needing to get their Marriage Licenses. Here is what I know.

I spoke to Rapides Clerk of Court office yesterday - I was told they are not issuing marriage licenses at this time. They didn’t have a date of when they would open. Yes, there are other parishes issuing licenses. Call before you go, some are only issuing licenses for residence of their parish. I’ve had to cancel eight weddings because of no licenses. I had three weddings this weekend, one is canceling and the other two are going to another parish to get married. We really need to get Rapides Parish back working.

How is an Eviction handled by
Justice of the Peace Court

Landlord/Tenant Laws/Evictions
The general public knows very little about what a Justice of the Peace does - we do way more than just weddings. I work at least 3-6 hours per day 7-days a week
Much of the time is spent answering questions on the phone. Yes, evictions are a major part of my job in Ward 8 of Rapides Parish.

Let’s talk
A Justice of the Peace has jurisdiction over a certain Ward in a certain District in a Parish.
I serve Rapides Parish Ward 8/Dist 5.
Evictions are a large part of my job and the part I dislike the most. I don’t want to see anyone evicted but if you don’t pay your rent or have other lease violations you will be evicted.
This information is based on the Attorney General’s Office and how the Justices in Louisiana are trained and educated to handle evictions.
Step By Step

1. Landlord must give a five (5) days notice to vacate to the tenant. Unless the (5) days is waived in the lease agreement.

2. Landlord must contact the Justice in the Ward where the rental property is located.

3. Landlord pays a fee of $100, provides lease agreement and signs the Petition of Eviction form at the office of the Justice of the Peace.

4. The Justice will set a court date and time. (Which cannot be less than three days from date of service of the Court Order)

5. The Justice issues a Court Order that summons the Tenant to Court to show cause why they should not be evicted within 24 hours of the court date.

6. The Constable or Deputy Constable is notified that there is a Court Order to be served. The Constable then serves the Order to the Tenant. This can be done by personal service or posting it on the Tenants door.

7. On the day of court. The Court is called to order and the Justice is the Judge that provides over the court. After the Tenant and Landlord have an opportunity to explain their position in regard to the Petition of Eviction/Court Order, the Justice makes a decision.

8. After hearing all the evidence and information. The Justice/Judge makes a decision to evict or not to evict.

9. A Judgement is issued and both Tenant and Landlord are notified of the decision.

Non-eviction means Tenant stays

Eviction means Tenant must vacate premises within 24 hours of court.

10. The initial Petition of Eviction has been completed.

I have read all of these wonderful things people are writing about you, and I feel that you might could possibly help me. I recently sold my home to the realtor with whom I had it listed, Steven Seales. He and Mr. J. D. Durand bought my house to flip it. The buy/sell agreement was that I could live in the guesthouse, free of charge (except utilities which I had been paying) until the main house was completely remodeled and put back on the market for sale. Mr. Seales decided to evict me after about four to five weeks, hardly any work done in the house, and took me to court on Friday evening at 5:30. The Justice of the Peace said I had to get out and gave me until 10:00 p.m. Monday night. I could not get a Uhaul until Tuesday morning. The Constable showed up Tuesday morning, along with the Grant Parish Sheriff's Office and forced me to leave. A worker who had been working on the house for Mr. Seales was told by Mr. Seales to take all of my belongings to the curb. I drove to my neighbor's house and watched as he loaded my John Deere lawnmower in his truck and leave. I called Mr. Seales and told him what happened and asked if he told him to do that. He said he didnt, and I called the Grant Parish Sheriff's Office, same men who were there earlier, and told them the man stole my lawnmower and they did NOTHING. After he returned, he was putting my things at the curb, but only after taking what he wanted and saying that Mr. Seales informed him I could not have. He also said that I only had that day to get all of my belongings and could not come back. One man moving belongings from a four bedroom, two bath home, a two bedroom guesthouse, a huge shop full of tools, etc., and a one acre lot with an inground pool full of plants and patio furniture, and I could not come back?????? It took him four days to move everything to the curb. Examples of things they said I could not take were a 60" Sony flat screen plasma TV, a kitchen island bar from Haverty's, all of my appliances, my washer and drier, my five different sets of outdoor patio furniture, my cherry oak entertainment center, three other TV's, two wooden rocking chairs, a wooden patio swing my grandfather built, tons of dishes, cherished what nots from my mother and grandmother, etc, etc. Please, tell me that what he did was ILLEGAL. I lost my personal things, not to mention precious belongings that meant more to me than any amount of money. WHAT CAN I DO? PLEASE HELP ME.
