Notice of Substantial Amendment to the 2025–2029 Consolidated Plan and the Program Year 2025 Annual Action Plan

The City of Anderson hereby provides notice of a Substantial Amendment to the 2025–2029 Consolidated Plan and the Program Year 2025 Annual Action Plan in accordance with the City’s Citizen Participation Plan and the U.S. Department of Housing and Urban Development (HUD) regulations at 24 CFR Part 91 and Part 570.

This amendment reflects language consistency with the Fiscal Year 2025 formula allocations authorized by the Consolidated Appropriations Act, Public Law 119-4, and updates to project funding.

Program Year 2025 HUD Allocations

• Community Development Block Grant (CDBG): $916,076.00
• HOME Investment Partnerships (HOME): $337,099.85

Purpose of the Amendment

• The Neighborhood Stabilization Program (NSP) was established by Division B, Title III of the Housing and Economic Recovery Act of 2008 (HERA) (Pub. L. 110-289, approved July 30, 2008). As established by HERA, NSP provided grants to all states and selected local governments on a formula basis.
Per the 2016 HUD Notice (FR–5933–N–01), NSP grantees may transfer Program Income (PI) to their CDBG program. Grantees must obtain HUD approval, comply with the 25% set-aside requirements (LH25) for income over $250,000, and manage funds within the DRGR system.

The June 14, 2016, notice allows the transfer of NSP 1 Program Income (PI) to the regular CDBG program. NSP program income received before, at the time of, or after closeout may be transferred to an annual CDBG program as provided in section N of the notice. Transferred funds will become CDBG program income upon receipt. Upon transfer, CDBG program income will be subject to all CDBG statutory and regulatory requirements for program income.

The City of Anderson, with HUD's approval, is proceeding with the closeout of the NSP 1 grant and the transfer of $95,323.38 in program income to the CDBG Program.

Proposed Amendment to Program Year 2025 CDBG Activity
• Amendment to Public Facilities & Infrastructure improvement activities: Enhance accessibility and safety, and park improvements totaling $95,323.38. Activities are expected to meet the HUD National Objective of Low- and Moderate-Income Area Benefit (LMA) or Urgent Need (UN).

Hello everyone,

Please find attached the Legal Notice, published in the Herald Bulletin today, Thursday, April 2, 2026, and a copy of the Substantial Amendment #3 Document.

Important update:

The expenditure deadline for COVID-19 funding is rapidly approaching. Substantial Amendment #3 serves to reallocate the CARES ACT CDBG CV and CV3 funding for the City of Anderson to meet the expenditure deadline established by Congress. Substantial Amendment #3 reallocates $297,414.19 in CDBG CV and CV3 funding to preventive measures intended to reduce the spread of viruses in public facilities. As the immediate impacts of the pandemic recede, it becomes harder to meet the program's regulatory requirements to serve households and businesses, which require a tie-back to the negative impacts of COVID on income, as required by HUD.

The City will expand its efforts to assist nonprofit and public agencies in installing commercial air purification systems that provide significant benefits, including improved indoor air quality that directly enhances employee health, increased productivity and reduced absenteeism, and mitigate the spread of viruses, bacteria, and pathogens, reducing the risk of sickness among employees and the public. The amendment will support other public facilities and Infrastructure needs that help prevent public health issues. The Substantial Amendment does not anticipate program income.

Substantial Amendment #3 to the 2019 Action Plans is necessary because the City is proposing to reallocate unexpended funding first allocated to the City during the height of the pandemic by the CARES Act of March 27, 2020, and the additional funding allocated on September 11, 2020, to address the crisis exacerbated by the pandemic. This amendment is the third amendment to the 2019 Annual Action Plan.

Public comment period:
All public comments are accepted by email, postal mail, and phone calls beginning Thursday, April 2, 2026. Please submit all email comments to [email protected] and phone comments to 765.648.6096 by Monday, May 4, 2026, by 3:00 pm. All public comments submitted by postal mail must be mailed to 120 East 8th Street, Rm 103, Anderson, IN 46016, and postmarked by Monday, May 4, 2026.
