If you've been wondering how retailers will respond to the penny shortage caused by the federal decision to end the minting of the penny last year, Maryland has the solution. MRA worked closely this year with Senator Dawn Gile and Delegate Pam Queen to pass SB893/HB1026, which establish the following guidelines for retailers to use to round change for cash transactions when exact change is not available: for totals ending in 1, 2, 6, or 7 cents, retailers may round down to the nearest nickel when providing change; for totals ending in 3, 4, 8, or 9 cents, retailers may round up to the nearest nickel. The emergency bill went into effect immediately when it was signed into law on Tuesday. This bipartisan policy will provide clarity and consistency for customers and retailers as we continue to navigate a world that is depending more and more on electronic transactions.

Recent public comments by Governor Wes Moore regarding so-called “predatory pricing” in grocery stores have created confusion about both existing law and the scope of newly signed legislation. Even prior to the new law, the Maryland Office of the Attorney General has no record of substantiated complaints indicating a pattern of grocery stores engaging in unlawful “predatory pricing increases” of the type described. Accurate public communication about consumer protection laws is essential. Maryland residents deserve clarity about their rights and confidence that existing laws already safeguard them from unfair and deceptive practices.
