Compliance matters year-round.

The ATCC's 2025 Enforcement of To***co Sales to Underrage Persons found 180 retailers with multiple violations for selling to***co or v***r products to people under 21. The ATCC holds license hearings to keep these products out of young hands.

The ATCC issues alcoholic beverages manufacturer and wholesaler licenses, as well as various permits for alcohol businesses, in addition to to***co products manufacturer and wholesaler licenses.

In fiscal year 2025, the ATCC collected a total of $185,936 in to***co license fees, $631,750 in alcohol license fees, and $1,210,860 in alcohol permit fees.

As part of the ATCC’s statewide survey of 371 ESD retailers, our agents assessed whether the correct 20% ESD tax rate was being applied. While some areas showed strong compliance, others revealed significant challenges.

Across Maryland counties, the survey found:
- Some counties had full compliance among retailers inspected.

- Others saw multiple retailers charging outdated rates of 6% or 12%.

- Several counties had retailers charging no tax at all on ESD purchases.

- And in a few areas, retailers were incorrectly applying the 60% tax rate, which only applies to containers of 5ml or less.

These differences highlight how tax compliance varies widely across Maryland—and why continued education and enforcement are essential to ensure fairness and protect state revenue.
