WINTER REGULATIONS

Parking Regulations and Ordinances

Every year we get asked questions in regards to winter parking and snow removal. Below are the primary ordinances for the winter. Please feel free to contact the Benton Police Department with any additional questions. We recommend the message option with any specific questions.

ALTERNATE SIDE PARKING (Ord 320-12(D))
This is one of the most frequently asked questions. From November 1-April 1 alternate side parking is in effect from midnight to 8 am whether it is snowing or not. This means if a person parks their vehicle on the side of the road at 5 pm on an odd numbered day and does not plan on moving the vehicle until the following morning, they would park on the evenly numbered side of the road. Any vehicle in violation of this is subject to a parking ticket and/or towed depending on the situation.

48 HOUR PARKING (Ord 320-11)
Any vehicle parked on the side of the road in the Village of Benton must be registered and in serviceable condition. All vehicles must be moved every 48 hours. This allows for street maintenance and cleaning as needed. Vehicles are subject to the same penalties as above.

SNOW REMOVAL ON SIDEWALKS (Ord 288-9)
In the Village of Benton we have a lot of people that enjoying walking in almost all weather conditions so snow removal is a huge safety concern. Snow and ice must be removed from all sidewalks within 24 hours of the snow ceasing to accumulate. This includes snow that is from natural or any other means.

SNOW REMOVAL ON MOVING VEHICLES (WI 346.88 (4))
I think everyone has seen the vehicle driving down the road with only a few inches of snow or ice cleared just in front of the drivers view with everything else covered in ice or snow. Not only is this a huge safety concern, it is also illegal. The state statute states that the front and side windows must be kept reasonably clean at all times and the view can not be obstructed. The citation for this is $175.30 so it is definitely cheaper to take a few seconds and clear the windows from snow and ice prior to driving.

Last night, August 5 2025, Multiple communities experience vehicle burglaries where unknown suspects broke into unlocked motor vehicles and removed items of value. Please remember to lock your vehicles and remove any items of value. Home cameras, such as Blink, Ring, etc are a great tool for preventing and solving crimes of this nature. Please remain observant and help prevent any crimes of this nature from happening in our community.

APRIL DEA DRUG TAKE BACK EVENT

*REMINDER*. Only a few days away. Any kind of medication is allowed. Prescription, over the counter, vitamins.

We will be hosting the DEA drug take back event on the 26th of April from 9-1 PM. This is a great opportunity to bring in expired and unused prescription and over the counter drugs and medication.

If you are unable to drop off medications on the day of the event, contact the Benton Police Department for early drop off.

HELP IDENTIFY

On Thursday April 3rd at about 328 pm the vehicle in the video drove up the wrong way on the one way drive leading from the Benton School to Park Ave at a higher rate of speed. This was during a time when the buses were actively loading, and students were walking home. The vehicle has Iowa license plates. Any assistance in identifying the vehicle and the driver would be greatly appreciated.

On Monday, April 7, a house will be transported down Main Street at about 10 AM. The north side of Main Street will be marked no parking on Sunday, April 6 until the conclusion of the move.
This is the side of the street where the bank is located.

For safety reasons, any vehicle parked in the no parking zones will be towed. If you are able to do off street parking on the south side, it will make the move easier for the crew doing the job. Thank you very much for your assistance.

PUBLIC ASSISTANCE REQUESTED

On 3/02/25 at about 845 to 9 PM an unknown subject committed criminal damage by puncturing three tires on a vehicle in the area of the old Quality Motors located at 242 W Main St in Benton. A surveillance video has a subject walking west towards Galena St and Temple Ave at about 858 PM. This person could be a witness to the events that occurred. Any assistance in identifying this person would be greatly appreciated.

Winter Snow Storm/ Alternate Side Parking Enforcement

(Please let your neighbors, family and friends know)

With the newly fallen snow today, alternate side parking will be strictly enforced for a minimum of the next two days Tonight at midnight all vehicles need to be parked on the odd numbered sides of the street. This is the south and west sides. Even days are the opposite.

Alternate side parking is enforced from 12 midnight to 8 am. Last snow storm we only had 6 violations

HANDS FREE / DISTRACTED DRIVING

Last week a resident was inquiring about the use of cellular devices and other electronics while driving. After the conversation I realized a lot of people are unaware of the current Wisconsin statutes and penalties. The surrounding communities have also had multiple accidents, with some being fatal, caused by inattentive driving and younger drivers on mobile devices. Here are a few of the current statutes

346.89(4)(a)
Use of a cellular phone or other wireless device by a driver with a permit or probationary license is prohibited.
***Any driver who possesses a probationary license cannot have a phone in their hand for any reason while in control of the vehicle.*** This is a primary offense and can be the reason for a traffic stop

Penalty $162.70 and 4 points assessed
$200.50 and 4 points for second offense in one year

346.89 (1)
Inattentive driving. Although it is legal to have a mobile device in your hand while driving, any signs of distracted driving while holding a cellular device, such as weaving in your lane, leaving lane of travel, slowing down and speeding up, etc are probable cause for a inatentive driving citation

Penalty $187.90 and 4 points assessed

346.89(3)(a)
Any driver actively texting or emailing while driving. This is the same penalty as inattentive driving.

346.89(4)(b)
using mobile device by any commercial motor vehicle operator. Any commercial vehicle operator must be 100% hands free and cannot have the phone or mobile device in their hand.
