As the New York Times reports, over a billion dollars in dark money has poured into the 2026 midterms, most notably in Michigan, Minnesota, Kansas and Texas. And disturbingly, this outrageous practice doesn’t represent the whole problem.

California Governor Gavin Newsom and his family have benefited from hundreds of thousands of dollars of donations from California’s large utilities. So, it is no surprise that he tried to protect his benefactors from the consequences of California wildfires– even fires caused by utility equipment. Over the course of Newsom’s political career, corporate and executive donations from PG&E, Edison Electric, SDG&E, and S0CalGas have supported his campaigns, his ballot initiatives, and he and his wife’s favorite charities.

Faced with the imminent depletion of California’s multi-billion-dollar wildfire insurance fund, Newsom fought for legislation that would limit the compensation that utilities owe to fire victims, and shift the cost to insurance companies. The higher cost to insurance companies would be passed along to homeowners in the form of higher premiums. Utility shareholders would avoid huge costs which would damage profitability, and even potentially lead to bankruptcy. Legislation such as this – which was being hammered out behind closed doors– is exactly what corporate donors hope to buy with their thousands and millions in spending.

However, the Governor backed down as legislators from his own party refused to accept the bill. Consumer advocates, insurance companies, and organized resistance from wildfire victims forced Newsom to accept a narrower deal, SB 492, which did not amount to a subsidy for the utilities. SB 492 instituted a "fast-pay" claims program with processing deadlines; retained survivors’ right to sue the utility; banned private equity and hedge fund investment in wildfire claims; and, sensibly, denied utility CEO bonuses in years their companies caused fatal fires.

If you have money, crime is legal in the United States. Taylor Farms, the source of the deadly cyclosporiasis outbreak, donated millions of dollars to Trump and other Republicans. These dollars help to delay federal rules for tracking contaminants in food; and government inspection of Taylor Farms plants has been lax. The timing and quantity of money ensures that you will not be able to convince an impartial jury that big money donations were not the root of the illness and deaths. But there will be no jury, no trial, and no accountability, thanks to the corruption occurring in public view.

It’s half a century past time for a solid campaign finance reform amendment to be added to our constitution. We have the power to create it if we learn how:

The Supreme Court upheld the Buckley v. Valeo decision on 6/30/26 in short "This Court has determined that political parties—as well as candidates, private individuals, and outside groups—may make unlimited independent expenditures during political campaigns".
The only legislative power above the Supreme Court is the Constitution.
There are two resolutions introduced in Congress at the time of this writing proposing amendments allowing the states to regulate contributions and expenditures: H.J.Res.122 and S.J.Res.78. No official effort has been taken to move these forward.
