🏦June 2nd - Wood County Planning Commission Update:

This evening, I attended the Wood County Planning Commission meeting, where a re-zoning request in Middleton Township was discussed and voted on.

The request involved 13 parcels located North of State Route 582 along State Route 25, as well as at Mercer Road and 582. The parcels are outlined in red in the map below. The application asked to change these parcels from their current Residential (R4) and Agricultural (A1) classifications to Light Industrial (M1), stating the need is for construction logistics. These parcels are adjacent to the current data center project area and do not include flood lanes or wetlands.

County residents were given the opportunity to share feedback and concerns. A Perrysburg resident who was unable to attend submitted her comments via email, which were read aloud to the board. She suggested the commission postpone making a decision until Meta could clarify whether the neighboring Apollo gas facility would be permitted to use the land for storage.

Faced with this request, the Planning Commission board had three options for their vote: 1) approve the re-zoning request, 2) postpone it to gather more information, or 3) deny the request.

Following the public comments and board discussion, the Planning Commission voted 4 to 2 to recommend approval of the re-zoning request.

📝Re-Zoning Process Next Steps:

It is important to note this vote is a Wood County Planning Commission recommendation, not a final decision. The process includes multiple steps before final approval:

• Middleton Township Zoning Commission: The recommendation now comes back to our local township level. The Zoning Commission will discuss and potentially vote on the request at their next regular meeting on Wednesday, June 10th at 7:00 PM at the Middleton Township Building.

• Middleton Township Trustees: Following the Zoning Commission's review and vote, the Trustees will then discuss and vote, as the final decision making authority, likely during the June 17th meeting.

Decisions of this magnitude require thoughtful care, and I do not take my responsibility lightly. Thank you to everyone who took the time to attend tonight, ask tough questions, and stay engaged as we navigate these complex decisions together.

📢 Ohio Pending Legislation Update: Data Centers

Below you will find another update on the pending state legislation around data centers and their current statuses.

If interested, please take a moment to review each piece of pending legislation and contact the listed committee leaders to share your support, opposition, or feedback.

1️⃣House Bill 646: Ohio Data Center Study Commission

Status: Passed the House unanimously (94-0); pending in the Senate Financial Institutions, Insurance, and Technology Committee.

What it does: Freezes new data center expansions to launch a strict 6 month independent study on their impacts on agricultural land, noise pollution, local water resources, and grid stability.

Who to Contact:
Chair: Sen. Steve Wilson | (614) 466-9737 | [email protected]
Vice Chair: Sen. George Lang | (614) 466-8072 | [email protected]
Ranking Member: Sen. Hearcel Craig | (614) 466-5131 | [email protected]

2️⃣House Bill 706: The Ratepayer Protection Act

Status: Pending in the House Energy Committee (Active hearings ongoing).

What it does: This bill is modeled after an AEP Ohio tariff approved by the PUCO. If passed data centers would be under a strict "take-or-pay" tariff structure. It requires them to sign a 12-year contract guaranteeing they will pay for at least 85% of the electricity they reserved, even if they use less. By forcing data centers to pay for their own infrastructure upgrades and supply demands via this tariff, the bill shields regular families and small businesses from having those massive costs shifted onto their monthly electric bills.

Who to Contact: * Chair: Rep. Monica Robb Blasdel | (614) 466-8022 | [email protected]
Vice Chair: Rep. Roy Klopfenstein | (614) 466-9690 | [email protected]
Ranking Member: Rep. Elgin Rogers, Jr. | (614) 466-1401 | [email protected]

3️⃣Senate Accountability Framework (Local Zoning Protection)

Status: Pending across multiple Senate Committees.

What it does: A multi bill package focused squarely on Local Control. It shields township and county zoning boards from state level pressure to approve high density tech infrastructure, mandates water use reporting caps, and strengthens PUCO oversight before massive energy loads can connect.

4️⃣House Bill 695: The Local Transparency / Anti-NDA Act

Status: Active hearings in the House Local Government Committee.

What it does: Bans tech companies from forcing local elected officials (like Township Trustees and County Commissioners) to sign strict Non-Disclosure Agreements (NDAs) during early project planning. It ensures local boards can openly discuss projected water and energy demands with residents.

Who to Contact:
Chair: Rep. Angela King | (614) 466-6344 | [email protected]
Vice Chair: Rep. Matthew Kishman | (614) 466-2994 | [email protected]
Ranking Member: Rep. Veronica Sims | (614) 466-2480 | [email protected]

5️⃣Senate Bill 378: Responsible Water Use by Data Centers Act

Status: Pending in the Senate Transportation Committee.

What it does: Shifts 100% of water and sewer utility expansion costs directly onto the data center developers instead of local taxpayers. It also strictly caps how many millions of gallons of water a data center can consume daily for cooling systems, requiring a specialized state permit to protect local aquifers.

Who to Contact:
Chair: Sen. Thomas Patton | (614) 466-4823 | [email protected]
Vice Chair: Sen. Tim Schaffer | (614) 466-5838 | [email protected]
Ranking Member: Sen. Nickie Antonio | (614) 466-5123 | [email protected]

6️⃣FAST-TRACKED STATE ACTION: JOINT COMMITTEE LAUNCHED
Because traditional bills can take months to pass, Statehouse leadership took urgent action by forming the new Bipartisan Joint Data Center Committee.

The Goal: This special committee is bypassing the usual slow legislative pipeline to hold immediate public hearings.

The Impact on Townships: Co-chairs Rep. Adam Holmes and Sen. Brian Chavez stated that the committee's focus is to bring tech giants and local leaders face-to-face to gather hard infrastructure data. They intend to push this data directly to township trustees and local officials right away, giving local boards the tools needed to update and protect our local zoning ordinances now rather than waiting on Columbus.
