This Friday an exceptional group of young people gathered in Lancaster for the first ever “Teen of the Year” presented by the Bee Group Newspapers. While there were only two winners every nominee should feel intense pride in their achievements. I’m happy to say we were successful in our efforts to override the County Executive’s veto of the youth hunting law. The final vote was 8-3 to override the veto. The Department of Environmental Conservation (DEC) says there have been ZERO incidents since this law was passed elsewhere in NYS. I want to thank the many organizations that came out to speak in favor of this measure. Your efforts helped push this over the finish line. Proper documents will be filed with New York State and the law will take effect immediately.

The County Executive and Administration have admitted that there were errors in their rollout of the mandates on businesses contained in the Biometrics Transparency and Privacy Act. The materials presented to the media included a major error that the notification mandate applied to all businesses, regardless of whether they collect biometric data or not. That was incorrect.

The County Executive called it a “clerical error,” but the same error was contained on the website, the published mandatory notice form, and in the prepared remarks from the Director of Consumer Protection and the County’s Director of Policy. It would seem that “clerical error” traveled pretty far. I called it out for being wrong, my office notified the administration and it has since been corrected.

The major concern I had was that in several sections of the law it permits the Erie County Director of Consumer Protection to promulgate rules regarding the enforcement and implementation of the law.

This “clerical error” was included everywhere, leaving one to assume it was going to be codified into the regulations when the rules are released. For now it is fixed, however this requirement is still a major burden and mandate on business owners in Erie County and it is clear those implementing the enforcement are confused about the law or incompetent. This is concerning to everyone, considering businesses have 30 days to comply or face $1000-$5000 PER DAY fines. There is no room for errors or confusion in rolling out regulations that can have that type of impact on our business community.

Today, the County Executive signed the law and rolled out several policies related to it, including a notice to ALL businesses in Erie County, whether they collect biometric data or not, that they MUST fill out the notice requirement on the County's website, or they will face the penalties. The law only applied this requirement to those knowingly collecting data and now through their enforcement they are applying provisions to ALL businesses, with very strict penalties for non compliance. This confirms the reason I voted no. This law was rushed and its implications and enforcement was not thoroughly vetted. I am working to get this back and track, so all businesses are not negatively impacted. This is an overreach of government authority and massive undue burden for small business.
