The Homestead Act of 1862
Signed into law by President Abraham Lincoln on May 20, 1862, the Homestead Act fundamentally transformed the American West. It opened up millions of acres of public land to small farmers by granting 160-acre parcels to any citizen willing to reside on and cultivate the property for at least five years.

Did You Know?
While the act passed in 1862, actual homesteading in Utah was completely blocked for seven years. Because federal law strictly required public land to be officially surveyed before anyone could claim it, Utah’s lack of federal mapping gridlocked the system from 1862 until 1869.

The territory’s first federal land office finally opened in Salt Lake City in March 1869—just two months before the golden spike was driven to complete the Transcontinental Railroad. Only then were Utah’s early settlers finally able to legally secure the land they had been living on and farming for decades.
