The Chicago Progressive Caucus writes to express our strong opposition to the proposed FAIR ordinance offered by some of our City Council colleagues.

Chicago is in a housing crisis, and protecting tenants is a huge part of solving it. But far from strengthening tenant stability, FAIR takes away existing rights, rolling back protections in the Residential Landlord Tenant Ordinance (RLTO) that have been law for 40 years.

FAIR would decimate existing tenant protections:

- Out of town landlords, as long as they own fewer than 12 units in Chicago, would no longer have to follow most of the RLTO. They wouldn’t have to provide 2 days’ notice to enter a tenant’s unit. They could charge unlimited late fees. Thousands of tenants in their buildings would lose rights overnight.

-Tenants would no longer be able to use the RLTO to terminate a lease when they are without heat in the winter, unless they can first prove the landlord is at fault

-FAIR guts the enforcement mechanism in the Fair Notice Ordinance, effectively allowing landlords to terminate leases and raise rent on one day’s notice

Our caucus urges continued negotiations with the Metropolitan Tenants Organization, Lugenia Burns Hope Center, ONE Northside, the Law Center for Better Housing, and other organizations that fight tirelessly to protect tenants across Chicago in order to pass legislation that meets our city’s needs. We will not support any proposal like FAIR, that strips away rights from tenants.
