📋 Compliance Update: The U.S. Department of Transportation (DOT) has issued clear, definitive guidance regarding the federal rescheduling of ma*****na and its impact on safety-sensitive workforce testing.

The bottom line: DOT drug and alcohol testing requirements remain completely unchanged.
Despite recent actions reclassifying certain state-licensed medical ma*****na products to Schedule III, the DOT Office of Drug and Alcohol Policy and Compliance (ODAPC) affirmed that:

1️⃣ State-dispensed ma*****na does not constitute an FDA-approved prescription medication.

2️⃣ Medical Review Officers (MROs) cannot verify a laboratory-confirmed positive THC test as negative based on state-issued medical cards, certifications, or dispensary receipts.

3️⃣ Ma*****na use remains strictly incompatible with safety-sensitive functions under 49 CFR Part 40.

Ensure your internal policies and communications to DOT safety-sensitive employees reflect this latest guidance. See the official announcement here:

USDOT issued official guidance confirming MROs cannot verify ma*****na positive drug tests as negative, despite recent rescheduling.
