Preguntas Frecuentes sobre la Tutela de Menores

¿Que es la tutela?
La tutela legal, conocida en inglés como “guardianship”, otorga la custodia y las responsabilidades parentales de un menor a alguien que no es su padre o madre. Esa persona, llamada tutor, debe asegurarse de que el niño reciba atención : médica, educación, comida, vivienda y ropa. La tutela permite que otra persona cuide del menor como lo harían sus propios padres.

¿Quién puede ser tutor?
Pueden ser tutores quienes sean aprobados por la corte, siempre que ésta determine que tienen la capacidad necesaria para cuidar al niño. Además, deben cumplir con ciertos requisitos: tener al menos 18 años, residir en Estados Unidos, y en algunos casos, contar con estatus legal (aunque algunos jueces aceptan tutores indocumentados). También deben tener capacidad mental, no estar incapacitados, y no tener condenas por delitos graves, salvo que la corte considere que aún así son la mejor opción, evaluando la naturaleza y fecha del delito, así como pruebas de rehabilitación. Sin embargo, quien tenga condenas por delitos graves que involucren daño o amenazas a un menor, incluidos delitos sexuales, queda automáticamente inhabilitado para ser tutor.
