What Is a Notary, Anyway?

A Notary Public is more than someone with a stamp.

In Tennessee, notaries are public officials selected through their county and commissioned under state law. Tennessee law gives notaries authority throughout the state to perform certain official acts, including acknowledging signatures, administering oaths, and taking .

What Can a Notary NOT Do?

A Notary Public may be a public official, but the commission does not come with unlimited powers.

For example, my notary commission does not authorize me to:

Fly an airplane.

Deliver a baby.

Teach you to bungee jump.

Perform a wedding just because I have a stamp.

Practice law.

Decide whether your document is legally sufficient.

Choose the type of notarization you need when that requires legal advice.

Prepare legal documents for you unless I am otherwise legally authorized to do so.

Give you legal advice or tell you what you should sign.

Notarize something simply because somebody really, really needs it notarized.

So what can I do?

Tennessee law gives a Notary Public specific powers. Those include taking acknowledgments, administering oaths and taking affidavits, along with certain other duties established by law.

The important word is specific.

A notary doesn't determine whether your contract is fair, whether your Power of Attorney gives someone the right powers, whether your estate plan accomplishes what you want, or whether signing a particular document is in your best interest.

Those are questions for an attorney.

“But the document says it needs to be notarized…”

Great! I can help with the notarization.

What I cannot do is become your lawyer simply because we're standing at my notary table.

My responsibility is to perform the appropriate notarial act properly and impartially—not to represent either side of the transaction.

And, unfortunately, the State of Tennessee still refuses to let me fly airplanes with my notary stamp.

Probably for the best.

Q: Where are you located?

A: Anywhere you need me. With banks, insurance offices, even my friends at the UPS Store 7334, you have to come into their location. With Cookeville Notary you can stay home in your comfy chair and I'll bring everything you need right to your door.

Can't or don't want to meet at home. That's fine too. I can meet you at your business, a coffee shop, a retail store, or somewhere you prefer. If you are in a hospital rehabilitation center, nursing home or similar location we can still come to you.

As an added bonus. I can now notarize your documents remotely. You can be working at a desk in Cookeville, sitting on a beach in Florida or working on the International Space Station. As long as you have a computer or tablet, an Internet connection and a credit report I can assist you.

In the second question of our most commonly asked questions: What Do I need to Bring?

In Tennessee, in order for me to notarize a document. I must have satisfactory proof that you are the same person named in the document. Normally this is completed with a driver license or state ID, passport, or military ID. As a general rule the ID needs to be current. If you don't have ID or don't have current ID, let us know there are other options that may be available.

You will also need a form of payment. Cash, checks, cards, Paypal, Venmo, and Cashapp are all available options.

You will normally need to place to sit and a surface we can sign on. If that's not possible again, let us know. We have clipboards and folding stools, just have to make sure have them loaded up.

Lastly you will need the document you need notarized. Cookeville Notary is able to print documents and bring them with us if needed.

Today's Question: How much will is cost?

The cost depends on the type of appointment and the amount of time, travel, printing, and preparation required.

To provide an accurate quote, I will ask:

What type of documents do you have?
Approximately how many documents or pages are involved?
How many people need to sign?
Are witnesses required, and will they be provided?
Do documents need to be printed?
Where would you like to meet?
What date and time do you need the appointment?

I operate as a mobile notary and travel to my clients. Mileage, travel time, appointment length, printing, supplies, after-hours service, and special circumstances may affect the total fee. Once I have the appointment details, I can provide a clear quote before confirming the visit. If circumstances change, I may adjust my fee accordingly.
