Dedicated Ways, LLC ADA consulting and TAS plan reviews and inspections in Texas I started Dedicated Ways, L.L.C. in 2013 after someone close became disabled.

Until then, I was only familiar with some items regarding accessibility from my job. After obtaining my status from the State as a Registered Accessibility Specialist, it opened my eyes to just how many architectural barriers there are in the world around us. Along with this license, and the guidance of my mentor and great friend Michael Quimbey, Sr., who has been working with accessibility issues

many years, I opened my business to help developers, architects, engineers, and property owners identify those barriers, and come up with solutions to provide equal access to all people, disabled included. I do State of Texas mandated Plan Reviews and Inspections, as well as consulting for both new and existing buildings, to help you become compliant with the latest laws associated with the Americans with Disabilities Act, as well as the Texas Accessibility Standards. Just a reminder that there are no exemptions from bringing your business into compliance due to the current pandemic, only some temporary delays in processing. Take this down time to come up with an acceptable plan of action to bring your business into compliance, so that when it is over, you can get ahead of the game. Based on some facts coming in about folks who are surviving this virus, some of them are being left with disabilities, and they will need help in getting into your business at some point. Dedicated Ways, LLC., is happy to set a meeting with you for a free initial consultation about your accessibility concerns and needs for your business. My main goal is to ensure you are in compliance with the standards to help you avoid getting into trouble with either complaints from individuals, or worse yet, lawsuits and judgments from local jurisdictions. Protect yourself and your business by having a plan of action, and implementing changes as soon as possible. It only takes one rogue agent of the DOJ, and a sympathetic judge, to levy fines up to $75,000 dollars per violation, per day that it is not fixed. Even with fuzzy math, anyone can see how that could put you out of business quickly if you are a small or medium sized business owner.

Did you know, that if you are disabled, or even without a disability, and you find a business that has no accessibility features like ramps near stairs, accessible parking spaces, etc., you can make an anonymous complaint to the US Department of Justice, and force them to come into compliance? Of course, it is ALWAYS best to talk to the ownership of the business first to ask them about their plan to retrofit their facility to remove the architectural barriers. However, if they seem to get angry with you, or say they do not need to because they do not cater to disabled people, you are encouraged to do so. Just remember, we have many veterans that are confined to wheelchairs, and we ALL owe them equal access to every public place that we can possibly make that way. If you have any doubt about a business, feel free to snap a picture of what you suspect and send it to the US DOJ to support your complaint.

Not sure if your business is in compliance with the latest standards for accessibility? I can help you determine that. Knowing you are compliant is power against anonymous complaints to the State, and worse yet, the US Department of Justice, where fines can be exceedingly expensive.

Do you think your business or property that is open to the public is exempt from being in compliance with the ADA because it is an older building, or the person or company you bought it from said it was compliant when they constructed it before 1993? Well think again. By law, you have to at least have a plan to bring your facility into compliance and be actively working on it over time as budgets allow to bring it into current codes. Let me help you by evaluating your facility to see what items you may need to update. If a disabled person files a complaint with the Department of Justice against you, you could face fines up to $75,000 per violation with your first offense. The fines go up from there, and those fines can be imposed per day that you do not have it fixed. Let that sink in a minute and think how quickly they could put you out of business. Food for thought in our current litigious society.

If you own a business, make sure you are aware that complying with the Americans With Disabilities Act is not a one time deal. You are responsible for keeping your property up to date. The last change in the law in general was in 2010. However, interpretations on those laws and items happen quite often, and in the end you are liable for keeping up with it. So if you are unsure where to find these, find an Accessibility Specialist to help. If you do not choose me, please choose someone. The Department of Justice does not just give you a verbal warning and never checks back in. They follow up, and their fines can easily put you out of business quick if you have multiple violations.
