CATSKILL — The man and woman accused in the February death of a 3-year-old Cairo girl both separately appeared in court Tuesday for a compliance hearing.
Lameik Wilson, 24, of Rochester**, pleaded not guilty March 11 to charges that include second-degree murder, a class A felony; first-degree manslaughter, a class B felony; reckless assault of a child, a class D felony; second-degree assault, a class D felony; and endangering the welfare of a child, a class A misdemeanor, related to the Feb. 25 death of Farhiya Gaal’s daughter, Fay Mohamed, 3 years old.
Fay died at Albany Medical Center, less than one month following the alleged assault, after doctors took her off of life support. Police suspect Wilson beat the child while Gaal was out on a job interview.
Gaal, 26, of Rochester**, also pleaded not guilty March 11 to charges of second-degree murder, a class A felony; second-degree manslaughter, a class C felony; first-degree perjury, a class D felony; and endangering the welfare of a child, a class A misdemeanor charge.
During a compliance hearing Tuesday morning, Greene County Assistant District Attorney Krista Kline said the prosecution believes all pieces of evidence in the cases against Wilson and Gaal have been submitted to the court.
Countless files from the Greene County Sheriff’s Office were turned over to the court, the prosecution team, which consists of Kline and Assistant District Attorney Monica Kenny-Keff, and Wilson’s defense team, made up of Greene County Public Defender Angelo Scaturro and Assistant Public Defender Marie Beckford, Kline said in court.
“Within those files, many different agencies ... obtained all of those items from all those entities,” Kline told Greene County Court Judge David Costanzo during Tuesday’s hearing. “We do believe that they have turned over everything in automatic and supplemental discovery.”
One of the items filed was redacted and the defense team did not have the time to look it over, Beckford said.
One of the evidentiary items turned over was Fay’s medical records from her monthlong stay at Albany Medical Center, where she died Feb. 25 of severe traumatic brain trauma caused by blunt-force trauma, Greene County District Attorney Joseph Stanzione said in March.
Gaal's hearing mirrored, and was held just before, Wilson's hearing, Stanzione said.
“We affirm on the record we turned over all the evidence they [the defense teams] are entitled to, pretty much everything we have,” Stanzione said Tuesday. “They are given a period of 45 days to look through and raise anything they think they have for more documentation they feel they are entitled to. They have the opportunity to punch through the documents.”
Gaal’s attorney, John Hillman, of Kinderhook, indicated that he was seeking to have a psychological evaluation performed on Gaal, Stanzione added.
“They are requesting an evaluation and claiming there is some psychological reason that would mitigate the charges against her,” Stanzione said. “However, if he does that, we will find out in the next 45 days. If that happens, we will have an expert evaluate her and find out what kind of defects exist. Maybe she was suffering under mental defects or acting under compulsion or force by Wilson, whatever it might be.”
Hillman did not immediately respond to requests for comment Tuesday.
Wilson was also arraigned March 25 on a second-degree assault, class D felony, charge involving incident on the same day in county jail. That case is pending.
The next court date for Wilson and Gaal is June 22
