This is why we need a new KCRCC chair and leadership.
Did KCRCC members know that the Secretary of State’s office, with input from the Attorney General’s office, had instructed Brent that Legal Defense Fund donations and expenditures should in fact be tracked under Idaho Sunshine laws BEFORE they voted to move those funds over to an outside PAC? Not sure they did.
The Secretary of State's office informed KCRCC Chair Brent Regan on March 27, 2026, a MONTH before the most recent KCRCC meeting, that all funds going to/coming from the Legal Defense Fund need to be reported in the Sunshine Reports, and all past reports need to be amended to show that money. Attached to this letter was the in-depth opinion from Attorney General Raúl Labrador office explaining that PAC money is PAC money, and it needs to be tracked.
Did Brent let the committee know about this little tidbit at the April 28 meeting? No. In fact, he said that they don't know who donated to the fund, records by the previous treasurer were not kept, and donations were "most likely from him anyway."
Does ANYONE on the committee know about this request from the SOS aside from Brent? Why didn't he mention it when the committee was having an extended discussion about this exact fund? What happens if Brent loses his PC position and Chair position? Would this omission have thrown the KCRCC into chaos? Was it on purpose or out of sheer ignorance? If it was on purpose does Brent deserve to be Chair? If it was out of sheer ignorance does Brent deserve to continue to be Chair if he can't remember pretty important information from the Secretary of State?
Whomever is elected to the KCRCC Executive Board after Tuesday's election will need to be able to hit the ground running and, I'm sorry to say, I don't believe that all the information will be given from the old Executive Board to the new one to seamlessly transfer leadership.
