Montezuma County Seeks Public Input on a Proposed Rubbish Ordinance

Montezuma County has received an increasing number of complaints from residents regarding the accumulation of trash, junk, and debris on private properties throughout the county.

In response, the Board of County Commissioners is considering the adoption of a county rubbish ordinance as authorized under Colorado Revised Statutes 30-15-401(1)(a)(I)(A). Such an ordinance would allow county code enforcement officers to issue citations for the accumulation of rubbish in violation of the ordinance and require that it be removed.

State law also places limits on this authority. Any ordinance adopted under this statute cannot apply to agricultural properties that are actively used for agricultural purposes or to industrial parcels larger than 10 acres.

If a property owner fails to remove the rubbish within a reasonable period after receiving notice, the ordinance would authorize the County to petition the court for an order allowing the County to remove the rubbish. The costs of the cleanup could then be assessed to the property owner as provided by law.

We want to hear from you. Before making any decisions, the Board of County Commissioners is seeking public input.

Please take a few minutes to complete our survey and share your thoughts. Your feedback will help the Board evaluate whether a county rubbish ordinance is appropriate for Montezuma County.
