Duxbury Sidewalk and Bike Path Committee Our meetings are open to the public, usually every first Tuesday of the month at the Duxbury Senior Center at 7:00 P.M.

PROTECTING VULNERABLE ROAD USERS

The Commonwealth of Massachusetts recently enacted legislation to reduce fatalities among Vulnerable Road Users. Vulnerable Road Users include, among others: construction workers, emergency responders, pedestrians, cyclists, skateboarders, wheelchair users, and horses.

House Bill No. 5103 “An Act to Reduce Traffic Fatalities” and Senate Bill No. 3162 amended Massachusetts General Laws Chapters 85, 89, and 90, requiring motorists to leave a safe distance of not less than four (4) feet clearance when passing Vulnerable Road Users at a reasonable and proper speed. When overtaking a Vulnerable Road User, the motorist may cross over a center line into an adjoining lane when it is safe to do so, while adhering to the roadway speed limit. Motorists must slow down or stop until a safe clearing distance is available.

The legislation also adds a requirement for nighttime cyclists to have a rear lamp emitting a red light AND a rear red reflector, in addition to a front lamp emitting a white light.

There are additional safety device requirements for trucks over 10,000 pounds that will be phased in beginning in 2023.

The legislation also includes the development of standardized accident forms for reporting incidents between vehicles and Vulnerable Road Users.

These new regulations help clarify the long-established “Share the Road” initiative. We all have rights and responsibilities on our roads. Let’s keep them safe for all.
