PBA Initiated Class 2 Special Pension Buyback Signed Into Law

Acting Governor Nick Scutari today signed into law legislation initiated by State PBA President Andreyev to permit Class 2 Special Police Officers - past, present and future - to purchase PFRS credit based on their service as specials.

“This bill resolves an inequity I have witnessed personally as a Point Pleasant Beach officer,” President Andreyev stated. “I have seen Class 2 officers work side by side doing the same work, get hired as full time officers, apply to the Division of Pensions to buy their time as Specials only to see one person approved and the other denied based on whose random desk the paperwork landed on. I felt strongly that this legislation was needed to provide a level playing field for all Class 2 Officers to have an opportunity to buy their time towards their PFRS pension.”

The legislation, sponsored by Assemblyman Anthony Verrelli and Senator Vin Gopal, provides that Class 2 Officers may purchase credit for all or a portion of the service, including time taken during such public employment to complete a basic police training course required for that employment. The officer will be required to pay both the member’s and employer’s share of the cost for the purchase which is the same process used to purchase military time. The purchase of credit will be permitted only if the break between service as such an officer and the date of their enrollment in the PFRS is less than 365 days. Members of the retirement system who are enrolled on the effective date of this bill will have only one year from that effective date to apply for such a purchase.

“I want to thank our Sponsors for working so closely with us on this priority legislation and for helping to fast track this so that it could pass the Legislature unanimously. We will be working with the PFRS Board to ensure the legislation is enacted smoothly according to the intent of the law,” Andreyev said.

Today four of our Elizabeth PBA Local #4 members were honorary guests at the 200 Club of Union County’s Annual Valor Award luncheon.

Detective Alexander Gonzalez, Detective Michael Nicolas, Detective Rui Xavier, and Detective Luis Figueiredo were presented with the Valor Award, which since 1968 has been presented to first responders who have demonstrated true bravery by risking their lives to serve the public interest.

PBA Local 134 - Parole Hearing for Stephen Perry

Brothers and Sisters,

Unfortunately, we recently relived the anniversary of the murder of Brother Joseph Rybka on January 7th. As you may know, we remain in close contact with Joe's family. Today we were informed that the parole hearing for his murderer, Stephen Perry, has been moved up to March 9th, 2022.

"On January 7, 1979, Deputy Joseph Rybka Jr., a 32-year-old husband, father, and 10-year veteran of the Bergen County Sheriff’s Office was assaulted and gunned down by Stephen Perry, a prisoner he was guarding at Bergen Pines hospital. Just two days previously, Perry was apprehended after committing an armed burglary. Prior to his arrest, Perry fired three shots at two police officers, hitting one in the wrist and chest. While hospitalized for his own injuries sustained during the pursuit, Perry gradually loosened the top of his metal IV pole and used it to assault Deputy Rybka, stealing the officer’s service revolver and fatally shooting him in the heart. Perry fired a total of four shots at Deputy Rybka before fleeing the scene, but was later apprehended, still armed with Deputy Rybka’s gun.

At the time of the murder, 22-year-old Perry had already been arrested 12 times, with an extensive criminal history prior to killing Deputy Rybka, including breaking and entering with intent to steal, assault with intent to kill, larceny, carrying a concealed weapon, assault with a dangerous weapon, and assault & battery on a police officer.

Even after being sentenced and jailed for Deputy Rybka’s murder, Perry continued racking up more than 50 additional infractions during his incarceration, including drug possession and distribution (he**in), assault, weapons possession, multiple counts of forgery and larceny, breaking & entry, and receiving stolen property.

Although he had a history of parole and probation violations prior to the murder of Deputy Rybka, and was sentenced to Life in Prison for that murder, and has committed and plead guilty to numerous infractions before and after being jailed, Perry is being considered for parole for the fifth time, in June 2022, less than two years after his previous denial.

Deputy Rybka’s family has been forced to relive his tragic murder and endure the painful process of providing a victim impact statement each time Perry is considered for early release. Deputy Rybka’s widow Patricia and their young son were also Perry’s victims, and deserve justice. The suffering repeatedly inflicted on Deputy Rybka’s loved ones is inhumane, and must be taken into account when determining a future parole eligibility date."
