PUBLIC HEARING NOTICE

The Martin County Planning Commission/Board of Adjustment will be conducting a public hearing on July 28, 2026 at 5:30 p.m. The hearing will be held in the Martin County Commissioners Room, located on the first floor of the Courthouse, 201 Lake Avenue – Fairmont, MN. The following items will be on the agenda:

After The Fact Variance Request from Tom Dauer (applicant/co-owner) and Jonathan and Shelly Hallberg, Rodger and Jill Taylor, Lars and Terrie Hallberg, Gwen and Jeffrey Matz, Randall and Kathy Taylor (co-owners) within Section 12 of Elm Creek Township. Tom Dauer has constructed a deck, which is currently located closer than the minimum required setback to the ordinary high-water level in an “SL-1” Special Protection District. The Martin County Zoning Ordinance requires a 200-foot setback from the ordinary high-water level in an “SL-1” Special Protection District.

Variance Request from John Anderson within Section 10 of Lake Fremont Township. John Anderson is proposing to construct a machine shed encroaching closer than the minimum required setback from the centerline of the public right-of-way in an “A” Agricultural District. The Martin County Zoning Ordinance requires a two hundred (200) feet setback from the centerline of any public right-of-way for a new building site effective February 17, 2004 and one hundred and thirty (130’) feet from the centerline of any public right-of-way for existing building sites constructed before February 17, 2004. Existing building sites cannot further encroach closer than the nearest present building from the centerline of the road provided greater than one hundred and thirty (130’) feet from the centerline in an “A” Agricultural District.

Conditional Use Permit from Mark Ufer (applicant/owner) and John Ufer (owner) within Section 28 of Waverly Township. Mark Ufer is proposing to construct a landing field in an “A” Agricultural District. The Martin County Zoning Ordinance requires a Conditional Use Permit for a landing field in “A” Agricultural District.

Conditional Use Permit from Duane Rosburg Construction (applicant) & Linda Shaw (property owner) within Section 19 of Fraser Township. Duane Rosburg Construction is proposing to operate a Demolition Disposal Facility and Recycling Facility in an “A” Agricultural District. The Martin County Zoning Ordinance requires a Conditional Use Permit for a Demolition Disposal Facility and a Recycling Facility in “A” Agricultural District.

NOTICE TO FARMERS

The Martin County Highway Department will soon begin spot spraying for noxious w**ds in county road ditches. The w**d spray the County uses is non-toxic to livestock. It is recommended to wait 14 days after spraying to allow the chemicals to work. Anyone wishing to maintain road ditches for hay crop must pick up small signs at the County Highway Department Shop in Fairmont or indicate on our County road map areas not to be sprayed. Please notify us each year of these areas (507-235-3347) or email: [email protected] “No Spray” areas are the individual’s responsibility for keeping the ditches free of noxious w**ds and should be mowed before thistles go to seed.

If you plan to harvest ditch hay to feed to livestock, it is your responsibility to either mark those ditches as “no spray” or to keep track of where you spread the manure from the livestock that is fed with that ditch hay. The chemical that the county uses to spray thistles can have a residual effect on soybean crops in manure from an animal fed with sprayed ditch hay, even after the chemical passes through the livestock’s digestive track. Anyone wishing to view the chemical’s product label should contact the Highway Department.

The Martin County Planning Commission/Board of Adjustment will be conducting a public hearing on May 26, 2026 at 5:30 p.m. The hearing will be held in the Martin County Commissioners Room, located on the first floor of the Courthouse, 201 Lake Avenue – Fairmont, MN. The following item will be on the agenda:

Variance Request from Bradley Schmidt within Section 22 of Lake Belt Township. Bradley Schmidt is proposing to construct a new home and driveway which will be located closer than the minimum required setback to the ordinary high-water level and closer than the minimum required setback from the road right of way in an “SL-1” Special Protection District. The Martin County Zoning Ordinance requires a 200-foot setback from the ordinary high-water level and 50-foot setback from the road right in an “SL-1” Special Protection District.

The above hearing is open to you and any interested persons at which time you may appear if you so desire, either in person or by agent or attorney, in opposition to or in support of the request. The hearing of this request is not limited to those receiving copies of this notice, and if you know any neighbor or affected property owner who for any reason has not received a copy, it would be appreciated if you would inform them of this hearing.

GENERAL NOTICE TO CONTROL OR ERADICATE NOXIOUS WEEDS

Notice is hereby given this 8th day of April, 2026 pursuant to Minnesota Statutes, Section 18.83, Subdivision 1 (2009), that all persons in Martin County, Minnesota, shall control or eradicate all noxious w**ds on land they occupy or are required to maintain. Control or eradication may be accomplished by any lawful method, but the method(s) applied may need to be repeated in order to prevent the spread of viable noxious w**d seeds and other propagating parts to other lands. Failure to comply with the general notice may mean that an individual notice, Minnesota Statutes, Section 18.83, Subdivision 2 (2013), will be issued. An individual notice may be appealed within two working days of receipt to the appeal committee in the county where the land is located. Failure to comply with an individual notice will mean that the inspector having jurisdiction may either hire the work done or seek a misdemeanor charge against the person(s) who failed to comply. If the work is hired done by the inspector, the cost can be placed as a tax upon the land and collected as other real estate taxes are collected. You may obtain a list of the plants that are designated as noxious w**ds and the members of the appeal committee from your County Agricultural Inspector or County Designated Employee. You can also obtain this information from your Local W**d Inspectors. Local W**d Inspectors include the township supervisors, city mayors or their appointed assistants. More information regarding the statewide listed noxious w**ds, the MN Noxious W**d Law and a list of County Agricultural Inspectors and County Designated Employees can be obtained from the Minnesota Department of Agriculture's Web Site by visiting: www.mda.state.mn.us/plants-insects/noxious-andinvasive-w**d-program .

PLANTING, PLOWING & DRIVEWAYS IN COUNTY RIGHT-OF-WAY

Please be advised that planting and plowing within the highway right-of-way as well as depositing field rocks is in violation of Minnesota Statute 160.27, as is removing, injuring or displacing right-of-way markers.

Also, all field and farm entrances built off a county roadway must have a permit from the Martin County Highway Department. If culvert is needed in entrances, it must be new corrugated metal pipe. Please call 507-235-3347 before building any field and farm entrances.

Violations of either of the above is a misdemeanor and may be subject to criminal and/or civil penalties.

The following item will be on the agenda:

Conditional Use Permit from Caleb Benes within Section 21 of Fairmont Township. Mr. Benes is proposing to relocate his monument business onto his existing farmstead in an “A” Agricultural District. The Martin County Zoning Ordinance requires a Conditional Use Permit in an “A” Agricultural District for any non-agricultural related retailers and/or businesses on existing farmsteads.

Variance Request (After the Fact) from Federated Rural Electric Association within Section 1 of Tenhassen Township. Federated Rural Electric Association has constructed a broadband utility shed that is an accessory building permitted in a “A” Agricultural District encroaching closer than the minimum required setback from the centerline of the public right-of-way in an “A” Agricultural District. The Martin County Zoning Ordinance requires a two hundred (200) feet setback from the centerline of any public right-of-way for a new building site effective February 17, 2004 and one hundred and thirty (130’) feet from the centerline of any public right-of-way for existing building sites constructed before February 17, 2004.
