On September 2, 2023, anyone 21 and older, NOT ALREADY PROHIBITED BY LAW, can carry a concealed handgun without a permit in Nebraska. We would like to share these reminders with residents.
We encourage you to seek out and participate in some type of fi****ms safety/training course. There are many different types of handguns available, although many appear to be the same, each may differ in their operation. An understanding of their operation and how to safely handle them is essential for safe operation, thus reducing the chances of a mishap.
Understand the laws:
The passage of LB77 resulted in several changes or amendments to various state statutes and local ordinances. There may be people who have yet to review and become familiar with the changes. We recommend you visit the Nebraska Legislature website and review Neb. Rev. Stat. §28-1201 to §28-1206. It’s important that everyone understands the changes to help prevent confusion and law violations.
▪️ Understand where you are and are not allowed to carry a concealed handgun:
There are locations where carrying a concealed handgun is not allowed. We recommend you visit the Nebraska Legislature website and review Neb. Rev. Stat. §28-1201 to §28-1206. The penalty for carrying a concealed handgun into a prohibited location is Class III Misdemeanor for a first offense, punishable by up to three months in jail and/or a $500 fine A second offense is a Class I Misdemeanor, punishable by up to one year in jail and/or a $1000 fine.
NRS 28-1202.01 Carrying Concealed Handgun
A person, other than a minor/prohibited person, may carry a concealed handgun anywhere in Nebraska, with or without a permit;
PROHIBITIONS:
Any place/premises where the owner/person in control prohibits carrying concealed
Law enforcement stations/offices, jails, courtrooms, governmental bodies and legislature, financial institution (security exempt), athletic event, school, college, place of worship (security exempt), hospital, political rally, establishment that 51% of income is alcohol (bars), or other locations prohibited by federal or state law
Does not apply to a qualified law enforcement officer or qualified retired law enforcement officer
NRS §28-1202.03 Carrying Concealed Handgun, ID Requirement
Anytime a person is carrying a concealed handgun, the person SHALL also carry identification.
Identification - valid driver's/operator's license, state ID card, military ID card, alien registration card, or passport.

$28-1202.04 Carrying Concealed Handgun, Contact with Police/Emergency Services
Whenever a person who is carrying a concealed handgun is contacted by a peace officer or emergency services personnel (firefighter, emergency medical service..), the person SHALL immediately inform them that they are carrying a concealed handgun.
During contact with a person carrying a concealed handgun, the peace officer/emergency personnel MAY secure the handgun or direct that it be secured during the duration of the contact if it is determined to be necessary for the safety of any person present, including officer/emergency personnel.
The person SHALL submit to the order to secure the handgun.
Officer/emergency services SHALL return the handgun if there is not a threat or criminal violation before releasing the person.
