TOWN OF GENEVA NOTICE OF PUBLIC HEARING - September 8, 2026

At a regular meeting of the Town Board of the Town of Geneva, in the County of Ontario, New York,
held at the Geneva Town Hall, Geneva, New York, on August 11th, 2026.

In the Matter ORDER CALLING FOR
PUBLIC HEARING
of

The Glass Factory Bay Heights Drainage District
in the Town of Geneva, in the County of
Ontario, New York.

WHEREAS, a written petition dated July 13, 2026, has been submitted in due form by Petitioners ("Petitioner"), containing the required signatures, which has been presented and filed with the Town Clerk of the Town of Geneva, Ontario County, New York, for the creation of the Glass Factory Bay Heights Drainage District (“District”), the boundaries of which are described in a map, plan and report prepared by Passero Engineering, attached to said Petition, and in Exhibit 1, attached hereto and made a part hereof (https://webgen1files1.revize.com/genevany/Documents/News%20Items/Glass%20Factory%20Bay%20Heights%20Drainage%20District%20Boundries.pdf?t=202608200927070), and

WHEREAS, the Town Board of the Town of Geneva, New York has determined that the map and plan prepared by Passero Engineering was prepared in such manner and detail as the Town Board has required relating to the creation of the District; and

WHEREAS, such map, plan and report has been duly filed in the office of the Town Clerk of the Town of Geneva, New York as an attachment to the Petition, and is available for public inspection thereat; and

WHEREAS, the improvements proposed consist of the construction and maintenance of drainage improvements with associated appurtenances to serve said District, in accordance with the aforementioned map, plan and report now on file in the office of the Town Clerk of said Town; and

WHEREAS, the Petitioners are not requesting the Town to construct any improvements for the District; and

WHEREAS, the Town will not bear any of the expenses of constructing the improvements within this District as the developer is paying 100% of these expenses; and

WHEREAS, the estimated cost of the district to the typical property or one-family or two-family home is $0 for debt service and $0 for operation and maintenance charges. The cost of constructing any future improvements shall be assessed, levied and collected from the several lots and parcels of land within the District in proportion as nearly as may be to the benefit which each lot or parcel will derive therefrom.

NOW, THEREFORE, be it ORDERED, that a public hearing of the Town Board of the Town of Geneva will be held on September 8th, 2026, at 6:00 p.m. at the Geneva Town Hall, 3750 County Road 6, Geneva, New York, to consider the Petition to establish the District, to consider creation of said District, including the environmental significance thereof, and to hear all persons interested in the subject thereof, concerning the same, and for such other and further action on the part of said Town Board, with relation to the premises; and

BE IT FURTHER ORDERED, that this Order Calling for a Public Hearing shall be published and posted as required by law.

PLEASE TAKE NOTICE, that a public hearing will be held by the Town Board of the Town of Geneva on the 8th day of September, 2026, at 6:00 p.m., at the Geneva Town Hall, 3750 County Road 6, Geneva, New York, regarding the adoption of a Local Law which would amend Chapter 130 (Solar Energy Systems) and Chapter 165 (Zoning) of the Code of the Town of Geneva as follows:

Chapter 130 (Solar Energy Systems) would be amended by deleting and adding certain definitions pertaining to solar energy systems and by amending regulations to comport with the new definitions.

Chapter 165 (Zoning) would be amended by deleting and adding certain definitions pertaining to solar energy systems, including the addition of definitions of Tier 1 Solar Energy Systems, Tier 2 Solar Energy Systems, Tier 3 Solar Energy Systems and Tier 4 Solar Energy Systems and as follows:

by amending the permitted accessory uses in the following zoning districts to change “Solar Energy System, Minor or Accessory, subject to provisions of Chapter 130” to “Tier 1 and Tier 2 Solar Energy Systems, subject to provisions of Chapter 130”:

R-1 Residential Suburban District
R-2 Residential Rural District
R-3 Residential Lakefront District
R-4 Residential Medium Density District
R-5 Residential High Density District
TC-1 Town Center Mixed-Use District
TC-2 Town Center Arterial District

by amending the uses permitted with site plan approval in the AG Agricultural District to add “Tier 3 solar energy systems, only north of White Springs Lane and west of County Road 6 and only on those parcels where the Honeoye soil type comprises less than 50% of the parcel’s acreage, subject to the provisions of Chapter 130” and “Tier 4 solar energy systems, only north of White Springs Lane and west of County Road 6 and only on parcels that are not designated by the USDA as prime agricultural soils 1-4, subject to the provisions of Chapter 130. Prime soils that have not been actively farmed in the five years previous to the application shall not be counted”.

by amending the permitted accessory uses in the following zoning districts to change “Solar Energy System, Major or Solar Farm, only north of White Springs Lane and west of County Road 6, subject to provisions of Chapter 130” to “Tier 1 and Tier 2 Solar Energy Systems, subject to provisions of Chapter 130”:

AG Agricultural District
B General Business District

by amending the permitted uses in the I-1 General Industrial District and the I-2 Light Industrial District to add “Tier 3 and Tier 4 Solar Energy Systems, subject to provisions of Chapter 130”.

by amending the permitted accessory uses in the I-1 General Industrial District, the I-2 Light Industrial District and the LV Lake View Overlay District to add “Tier 1 and Tier 2 Solar Energy Systems, subject to provisions of Chapter 130”.

by amending the prohibited uses in the LV Lake View Overlay District) to add “Tier 3 and Tier 4 Solar Energy Systems occupying more than one acre within 1,000 feet of New York State Route 14, or within any viewshed between a public street or highway and Seneca Lake”.
