🔴 From Senator Janice Rich—
“ Since I am being attacked and accused by RMGO, I thought it best for you to see my response. No one more surprised than me to be accused of carrying a gun bill.
Here you go:
HB26-1108 is a companion bill to SB25-146 that passed last year concerning fingerprinting of those in professional fields. (Passed Unanimously in Senate; 59 to 3 in the House)
Having been accused of carrying a gun bill, I reached out to the Dept of Public Safety; they provided the following to me by the Colorado concerning HB26-1108:
“Colorado law requires applicants in many professional fields to pass fingerprint-based criminal history checks before taking up employment with vulnerable populations and in positions of trust. Currently, if an individual employed in one of these professions is arrested in Colorado, the CBI is notified. However, if this individual is arrested in another state, Colorado is NOT notified.
The FBI Rap Back program was created to address this information gap by alerting CBI when an individual working in a qualifying profession is arrested and fingerprinted out of state. This free service is available only to authorized agencies. It must be requested through the FBI, and participation must be formally authorized through state statute.
The Rap Back program is NOT a two-way information-sharing or tracking program. Participation does not allow the FBI or any governmental or law enforcement agency to access other information about those living and working in Colorado. This is simply a notification from the FBI to the CBI of an out-of-state arrest involving a previously fingerprinted individual in a position of trust.
Professional applicants who are required to undergo fingerprint-based background checks in Colorado include those with access to children through schools, childcare, foster care, adoption, and medical settings. Additional professions include those who work with money, as well as government employees and law enforcement.”
Again, the above information was provided by the Colo Department of Public Safety.
I realize I may not be able to convince you of what this Bill actually does, but I wanted the opportunity to share this with you.
