HMMMM, how is it that Council never has any open discussions on spending $605,000. Could they be having decisions made during their excessive Executive Sessions? Guess that could be why they can only refer to the Tax burden purpose by "Project", without any specific information! Shame on you Council!

Kyle Smith won a lawsuit against the Village of Cleves for improperly holding a closed executive session, but the village plans to appeal.

Legal and Ethical Violations
Public Contracts Prohibition:

Ohio law prohibits public officials or employees from using their position or influence to secure a public contract in which they, a family member, or a business associate have a financial interest.
Felony Offense: Violating the Ohio Ethics Law regarding public contracts is a fourth-degree felony. Any contract entered into in violation of this section is void and unenforceable.

Competitive Bidding Requirements: State law requires that most sales of public lands be conducted via public auction or sealed bids after public notice has been given (usually by publication in a newspaper for several weeks). This ensures transparency and the best value for the public.

Employee Restrictions: Specific municipal codes often explicitly state that no city employee or their immediate family may purchase property from the city except by sealed bid or at a public auction.

Conflict of Interest: Selling property to an employee without an open and competitive process creates a conflict of interest and the potential for self-dealing, which the law aims to prevent.
