Sheriffs already have authority and capability to expand their role in public safety. What’s missing is a clear, consistent legal definition.

From a policy perspective, creating clarity through codification would enhance the ability of our sheriffs to do what they need to do, when they need to do it — thus relieving strain on law enforcement and maximizing their overall impact in the community.

We will continue pushing for greater clarity from the legislature to enable our sheriffs to serve at their full potential.

Even with training equal to or better than any in the state, statutory law provides limited clarity on sheriffs’ authority. Courts have weighed in, but rulings are inconsistent and narrow, repeatedly signaling the need for legislative resolution. ⚖️

Authority also varies by county, further complicated by conflicting case law elsewhere. As a result, sheriffs face operational limits driven less by capability than by budget, prosecutorial, and liability concerns tied to unclear law.

These inconsistencies create confusion, legal risk, and inefficiency, preventing sheriffs from fully meeting public expectations.

It’s clear that sheriffs have the authority and capability. What they need is clarity…
