Fireworks ordinance amended for incorporated town of Higden.

“Amended on 4/14/26 to include usage of Salute-type fireworks, including maroons or reports, may be discharged only with prior written permission of the Town Council, and only if such devices are lawful under applicable state and federal law and are used only within the dates and hours set forth in this ordinance. "Salute-type fireworks" are pyrotechnic devices designed mainly to produce a loud report and maroons or reports are examples of that category. These are typically treated more like special fireworks. A permitted shooter will be required to use devices lawfully and in compliance with local/state fire marshal rules.
5. Amended on 4/14/26 to include Evidence of such violation may be by observation of a law enforcement officer, multiple independent complaints, audio or video recordings, physical evidence of firework use.
Section 3: Exemptions
1. Public Fireworks Displays:
Public fireworks displays conducted by licensed pyrotechnicians and authorized by the Town Council may be permitted at times outside the allowed dates and times specified in Section 2, provided the event complies with all safety guidelines and regulations.
2. Emergency Exemptions:
The Town Council may grant temporary exemptions to this ordinance in cases of emergency, such as during a public safety or community event, where fireworks may be used outside the dates and times.
