This isn't true. I wasn't arrested at all. The HPD failed, in 4 months to go to my registered address; So, since they so desperately needed help with the most basic I drove over to Bath and turned myself in.

But while we're on it - Let's consider a moment why Andy at the Sun was so quick to post this that he couldn't even get the facts straight and completely neglected the Federal Civil Rights suit the city quietly settled.

If you all need anymore evidence that it's choreographed corruption this is it

What the Sun also failed at in their 'investigation' is that I went after the video 'evidence' for my own evidence until the HPD got to it first. So their evidence isn't evidence at all.

There's a term in the military called low morale. It's what happens when troops stop believing their effort matters. Discipline slips. Standards drop. People go through the motions because nobody above them seems to care either.

Towns can catch the same sickness. Call it collective low self-esteem, or low social-esteem if you want a cleaner name. It's when a whole community quietly accepts dysfunction because nobody around them remembers what a functional place even looks like.

That's how civil servants get away with things they'd never get away with somewhere else. That's how mediocrity becomes the ceiling rather than the floor. People don't push back because they don't think pushing back does anything. They don't demand better because some part of them isn't sure they deserve better. That isn't laziness. It isn't even apathy. It's closer to Stockholm Syndrome, where folks get emotionally attached to the same broken systems that keep letting them down.

𝗣𝗲𝗿𝗳𝗲𝗰𝘁 𝗘𝘅𝗮𝗺𝗽𝗹𝗲: 𝗛𝗼𝗿𝗻𝗲𝗹𝗹, 𝗡𝗬

Look at what we're living with:

- A hospital catching heat for the quality of care it gives
- A city government with an ongoing misconduct problem
- A police department nobody fully trusts
- One of the biggest employers in town owned by a foreign entity with zero real loyalty to this place
- Local businesses getting choked out because Walmart decides what survives

etc etc...

In a healthier town, any single one of those things would have people showing up at meetings with signs. Here? It barely makes the rounds at the diner. "That's just Hornell." "That's how it's always been." Those aren't observations. They're surrender in the guise of wisdom.

𝗧𝗵𝗲 𝗢𝗹𝗱𝗲𝗿 𝗚𝗲𝗻𝗲𝗿𝗮𝘁𝗶𝗼𝗻 𝗕𝘂𝗶𝗹𝘁 𝗮 𝗛𝗼𝘂𝘀𝗲 𝗡𝗼𝗯𝗼𝗱𝘆 𝗪𝗮𝗻𝘁𝘀 𝘁𝗼 𝗟𝗶𝘃𝗲 𝗜𝗻

A lot of older folks here spent their whole lives learning to accept it. Complaining feels disloyal, almost like talking bad about family. So they swallow it, and they expect the rest of us to swallow it too. The dysfunction gets handed down like a set of rusted keys to a house that needs gutted to the studs.

And if the younger generation doesn't refuse the inheritance, nothing changes. "It's always been this way" is NOT the same thing as "it has to stay this way." Somebody has to be the first to say it out loud, and then somebody else has to say it louder.

We deserve better. We're done pretending we don't.. At least I am, hopefully you too

Some (maybe many) consider me arrogant. I call it 'wearing my competence on my sleeve'. Whatever it is I'm much too full of self esteem to let myself be trampled on by lesser men. I encourage you all towards the same mindset

A request for anyone who works downtown close to City Hall - BK, HH, TB - take notes and a log: everyone you see go into or out of city hall in an official capacity. Time; Name of person; license plate if you don't know them or look official from out of town.

This isn't illegal, they won't dare go around looking for those who are. Someone could sit on the bench outside logging it all and they couldn't do anything.

The intel could greatly benefit the investigation. They're in-cover-their-ass mode right now; that incessant humming you all heard last night was the paper shredders, and Buckley will be calling Hogan for advice and help soon, if he hasn't already.

If you want to help this would be a great way of doing it. Don't not do it because you know someone who already is, do it anyways.

Think of it as Trainspotting 2000, the corrupt municipality version

Mayor John Buckley presides over the Department of Public Safety, you're complicit too. You need to step down from your role as mayor.

This isn't a request. It's a demand from a resident of this city who has had enough.

Mayor Buckley has presided over three-plus years of institutional cover that has compromised the entire Hornell Police Department. Under his watch, two officers: Sgt. Tom Aini and Chief Ted Murray, who should have been Brady/Giglio listed following a federal civil rights settlement were allowed to remain in full operational capacity. No restrictions. No disclosures. No accountability. Nothing.

That means every arrest, every warrant, every affidavit, every prosecution this department generated during that period is now under a cloud. That's on John Buckley.

He knew. The question of whether the Steuben County DA knew is being actively pursued.

And the local media? Seven years of silence. Not a word.

The cover-up didn't protect this city. It endangered it. Every resident who had contact with this police department during that period, every defendant, every witness, every person named in an HPD report deserves to know that the oversight that was supposed to protect them was deliberately withheld.

Mayor Buckley has forfeited the public trust. He can no longer lead this city with integrity. He can't investigate himself. He can't reform a department he chose to protect over the people who pay for it.

We call on Mayor John Buckley to resign immediately.

We call on the Hornell Common Council to appoint a temporary, independent administrator while a full, independent investigation by the New York Attorney General and LEMIO proceeds. Not HPD. Not the Steuben County DA. Independent.

The residents of Hornell deserve leadership they can trust.

That's no longer John Buckley.

You need to hear something the local media can't be trusted to tell you:

A civil settlement does not close the door on criminal charges.

The City of Hornell quietly settled a federal civil rights case - Kearse v. Aini and thought that was the end of it. It's not. The two officers at the center of that case, Sgt. Tom Aini and Chief Ted Murray, can still face criminal prosecution. The settlement paid the victims off. It didn't exonerate anyone. It isn't an acquittal and it's not a finding of innocence. It's a city writing a check to make a problem disappear.

They may have their own exposure for failing to Brady/Giglio list them. A conflicted DA can't police themselves, it's mindless to argue otherwise.

That's why we need it at the State and Federal level.

So now's the time if you have any information. Those who feared before can now rise, let their voices be heard

Don't let the illegal actions of those before you ruin you. Don't let misguided notions of this being ACAB motivated woo you. I'm not an ACAB knucklehead. A little known tidbit about my family, and I never talk about my family - my maternal grandfather was NYPD for years and held the record for highest score on the officers civil service exam for decades. He was honorable and never had a black mark against him. That's a source of pride for my family; and it's a standard that all officers should aspire to. Let your badge roar 'I'm bound by a higher standard' rather than wreak of some imagined, righteous immunity. There are some officers who will go down because of Murray and Aini, if they do it's because that's what they've chosen. There are still some of you untainted by these two and those like them, don't let their toxins touch you. This is the same advise you'd give to a co-defendant of a main perpetrator in an interrogation room. You have long amazing careers ahead of you, possibly full of medals and honor. Murray, Aini and those they touch don't have this future. For over 3 years that department has been blackened with a compromised chief and lead investigator running it. Do any of you realize what you look like from the outside being commanded by a loser like Murray. He's corrupt, he's a walking tension box; grovelling to everyone who crosses his path because he's so compromised. He doesn't follow proper firearm safety and guidelines. No one looks at him and says 'Whoa. That's a strong leader there, if only he were my mentor". He has weak and paltry written all over him. He's a man burdened by the weight of many secrets; when he goes down for this, and he will, he is going to sing, sing, sing. The city covered him on this settlement and then gave him a slap on the wrist for misplacing his firearm less than 2 years later??!! Why? Who's secrets is he holding?? This man is a timebomb who's going to bring you down with him if he can.

Your careers are going to be defined by this je****ff. Are you really alright with that? Do you want to be compared to that dark souled, psychotic, corrupted s**tbag Aini your entire careers?
This here, what you do here, is going to be a defining moment for many of you. There will be investigations, there will be fall guys and scapegoats. There'll be a few relatively unaffected, and then there'll be the smart, prepared ones who come out smelling like roses. Which one will you be?

I'm sure not everyone knows what a Brady/Giglio list is. A Brady/Giglio list is a record prosecutors keep of police officers who have lied, cheated, or done something dishonest in the past; because if that officer is going to testify in a case, the law says the defense has a right to know so they can question whether the officer is telling the truth this time. Think of it like a 's*x register' for cops: once an officer earns a spot on the list, you can't trust them around your daughters anymore, so to speak. We already have at least one in the local Trooper barracks down here who assaulted a woman he pulled over for DUI in one of the rich counties up north; so, not wanting to waste the investment in training they've already made, the state keeps him active but relegates them to the poorer counties. But that's an aside, let's stay focused.

Over 3 years ago the city made a confidential settlement with plaintiffs concerning a federal civil rights case that was filed pro se (without counsel), held up through at least 2 motions to dismiss and ended in a yet undisclosed settlement. Meaning these plaintiffs had plausible enough claims and the city needed it ended. The local media blacked it out. They had to. The chief of police and lead investigator compromised, confidential settlement or not, it doesn't rehabilitate these sick f***s. The illness persists. The plaintiffs almost lost their kids permanently for a case that was dismissed less than 2 months later. A DSS supervisor was also named in the civil rights case, this doesn't concern her.

This concerns, not only the absolute deception of the city leadership, it's police department and local media towards it's own public, their neighbors and families to lie and conceal it but THEY ALLOWED 2 OFFICERS THAT SHOULD BE BRADY/GIGLIO LISTED TO CONTINUE IN FULL OPERATIONAL CAPACITY!! That means the cover-up could possibly be at the county level, maybe even our Senator's office knew about it.

The city leadership decided not to restrict or limit their duties at all and to keep them on in full capacity. They had to in order to hide it. What about county leadership? Where were they?

Now, what would working under a compromised and corrupt chief and lead investigator, both of whom were named in a federal civil rights case that the city quietly settled, do to an entire police department after 3+ years?? Seems like everything the department did - arrests, issued warrants, statements, affidavits by officers - all of them need to be investigated and reviewed. All of it is potentially compromised.

The Chief can't keep track of his firearm, doesn't assert control of his corrupt officers and looks the other way when they plant evidence that gets people children taken from them. It's not enough to only refer to them as Bloated Barney Fife and Sociopathic Gomer Pyle anymore. They're Tom Aini and Ted Murray and now the entire police department by association. The irony almost gives me an er****on.

This is what the new generations of upcoming LEOs are learning from?? We can't have this become generational. We need to put our collective feet down. City leadership owes everyone a public explanation; and the entire department needs to be replaced.

𝗧𝗵𝗲 𝗘𝗻𝘁𝗶𝗿𝗲 𝗛𝗼𝗿𝗻𝗲𝗹𝗹 𝗣𝗼𝗹𝗶𝗰𝗲 𝗗𝗲𝗽𝘁 𝗶𝘀 𝗖𝗼𝗺𝗽𝗿𝗼𝗺𝗶𝘀𝗲𝗱 𝗮𝗻𝗱 𝗡𝗲𝗲𝗱𝘀 𝘁𝗼 𝗯𝗲 𝗽𝘂𝘁 𝘂𝗻𝗱𝗲𝗿 𝗜𝗻𝘃𝗲𝘀𝘁𝗶𝗴𝗮𝘁𝗶𝗼𝗻.

Back in June of 2018 an HPD Task Unit (this fact is relevant later) executed a warrant on Platt St. The arrests made that day led to these people's children being taken from them. There's a co-defendant from the DSS named in the ensuing civil case because of it. HPD lauded this arrest on Facebook. Less than 2 months later the criminal charges on the parents were dismissed - HPD said nothing about that.

The parents filed a federal civil rights case against Aini, that name again (and everyone thinks I'm the as***le). They alleged that Aini planted the co***ne and it was a false arrest. Ted Murray was implicated for failure to intervene (read: didn't say or do s**t while Aini was allegedly planting evidence for a false arrest that culminated in the parents losing their children).

Motions to dismiss by defendants and the DSS agents counsel were denied - that means that a federal judge decided that a pro se case (one filed without counsel) held plausible enough claims to continue.

As of January 31, 2023, the federal court recommended (a Magistrate Judge's written finding that Aini plausibly fabricated evidence and Murray plausibly failed to intervene) that the false arrest claim against Sgt. Aini, the supervisory failure-to-intervene claim against Chief Murray, and the due process claim against the DSS Supervisor all proceed past the motion-to-dismiss stage. The case was in active federal litigation as of that date. There is a strong legal argument, maybe obligation, for both these officers to be placed on the Brady/Giglio list.

There was a total local media blackout on this. Why? Because, as stated above, it was a Task Unit - meaning more than Aini and Murray were present, potentially implcated, not only every officer present but every officer who has served under Murray since; meaning the entire HPD is compromised and everything they've done since then needs to be reviewed, investigated. Every case, every warrant, every testimony is suspect now. None of their arrests are legitimate until they're cleared by such investigations.

If you've had any dealings with the HPD since 2023 you need to talk to your lawyers.

Ted Murray works very closely with certain personalities in the city's leadership who might get too close and get burnt. Everyone in Hornell should feel betrayed by their police, their leadership and their media over this. How many other families have these men ruined?

Last night I sent formal requests to Steuben County DA, Brooks Baker, Assemblyman Phil Palmesano and Senator Tom O'mara.
I also sent a formal request to Mayor Buckley and every member of the common council to remove both Murray and Aini from the force pending further investigation.

Today both the Steuben and Alleghany County Public Defender's office, a number of local Defense Attorneys, The Attorney General, The Investigator General, The FBI field office in Buffalo, certain members of the media, civil rights and ACLU lawyers throughout Western NY and the Finger Lakes have been informed.

I've just recently managed to get my hands on the final dispositions of this case - confidential settlement.

Both federal civil rights actions against Sgt. Aini and Chief Murray have settled. The City of Hornell - meaning Hornell taxpayers - paid to resolve claims that a federal court found plausibly stated false arrest and fabrication of evidence against Sgt. Aini and supervisory failure to intervene against Chief Murray. No admission of liability was made, and the settlement terms remain confidential. Both officers remain in active duty. The settlement payments are themselves Brady/Giglio material that the Steuben County District Attorney is constitutionally required to disclose in every case in which these officers testify or contributed to the investigative record. That disclosure has apparently not been made.

The city used your money to pay off a settlement. They implemented a total media black out and then to add insult to injury and rub your plebian little noses in it they kept these officers on, to not only continue terrorizing tax paying citizen, but to further corrupt younger generations of law enforcement officers. That was Buckley's call

Everything I've stated here is the truth and documented in the public record up until January 2023. After that nothing publicly. I'm in possession of the confidential settlement disclosure that eventually also named the city as a co-defendant.

Buckley, you're lucky I didn't find this out until after the election, buddy.
