Back in June of 2018 an HPD Task Unit (this fact is relevant later) executed a warrant on Platt St. The arrests made that day led to these people's children being taken from them. There's a co-defendant from the DSS named in the ensuing civil case because of it. HPD lauded this arrest on Facebook. Less than 2 months later the criminal charges on the parents were dismissed - HPD said nothing about that.
The parents filed a federal civil rights case against Aini, that name again (and everyone thinks I'm the as***le). They alleged that Aini planted the co***ne and it was a false arrest. Ted Murray was implicated for failure to intervene (read: didn't say or do s**t while Aini was allegedly planting evidence for a false arrest that culminated in the parents losing their children).
Motions to dismiss by defendants and the DSS agents counsel were denied - that means that a federal judge decided that a pro se case (one filed without counsel) held plausible enough claims to continue.
As of January 31, 2023, the federal court recommended (a Magistrate Judge's written finding that Aini plausibly fabricated evidence and Murray plausibly failed to intervene) that the false arrest claim against Sgt. Aini, the supervisory failure-to-intervene claim against Chief Murray, and the due process claim against the DSS Supervisor all proceed past the motion-to-dismiss stage. The case was in active federal litigation as of that date. There is a strong legal argument, maybe obligation, for both these officers to be placed on the Brady/Giglio list.
There was a total local media blackout on this. Why? Because, as stated above, it was a Task Unit - meaning more than Aini and Murray were present, potentially implcated, not only every officer present but every officer who has served under Murray since; meaning the entire HPD is compromised and everything they've done since then needs to be reviewed, investigated. Every case, every warrant, every testimony is suspect now. None of their arrests are legitimate until they're cleared by such investigations.
If you've had any dealings with the HPD since 2023 you need to talk to your lawyers.
Ted Murray works very closely with certain personalities in the city's leadership who might get too close and get burnt. Everyone in Hornell should feel betrayed by their police, their leadership and their media over this. How many other families have these men ruined?
Last night I sent formal requests to Steuben County DA, Brooks Baker, Assemblyman Phil Palmesano and Senator Tom O'mara.
I also sent a formal request to Mayor Buckley and every member of the common council to remove both Murray and Aini from the force pending further investigation.
Today both the Steuben and Alleghany County Public Defender's office, a number of local Defense Attorneys, The Attorney General, The Investigator General, The FBI field office in Buffalo, certain members of the media, civil rights and ACLU lawyers throughout Western NY and the Finger Lakes have been informed.
I've just recently managed to get my hands on the final dispositions of this case - confidential settlement.
Both federal civil rights actions against Sgt. Aini and Chief Murray have settled. The City of Hornell - meaning Hornell taxpayers - paid to resolve claims that a federal court found plausibly stated false arrest and fabrication of evidence against Sgt. Aini and supervisory failure to intervene against Chief Murray. No admission of liability was made, and the settlement terms remain confidential. Both officers remain in active duty. The settlement payments are themselves Brady/Giglio material that the Steuben County District Attorney is constitutionally required to disclose in every case in which these officers testify or contributed to the investigative record. That disclosure has apparently not been made.
The city used your money to pay off a settlement. They implemented a total media black out and then to add insult to injury and rub your plebian little noses in it they kept these officers on, to not only continue terrorizing tax paying citizen, but to further corrupt younger generations of law enforcement officers. That was Buckley's call
Everything I've stated here is the truth and documented in the public record up until January 2023. After that nothing publicly. I'm in possession of the confidential settlement disclosure that eventually also named the city as a co-defendant.
Buckley, you're lucky I didn't find this out until after the election, buddy.
