"United for Better Pakistan"is a non-profit, non-partisan, non-political organization based in USA striving to establish a civil society network of Pakistanis both inside and outside Pakistan along with working as a Think Tank focused on presenting practical solutions to complex problems Pakistan is facing today. This initiative is going to advocate & campaign for a constitutional package which is
geared towards good governance, embedded accountability and rectifying problems in malfunctioning systems in Pakistan. Independent Board Of Directors For Accountability.
The proposed legislation puts forward the idea of a complete renovation of the electoral process. This will require some primary changes in the current electing system like introducing the Primary Election System (e.g. U.S) and an electoral process similar to one in Scandinavian countries.
The chief objective of this system is the âpre-registration of every voter (in any constituency ) through a political party. This will highlight the voterâs inclination towards any specific political party even if they donât vote for that particular party.
Primary elections are open to all registered voters. Similar to general elections, voting is done through a secret ballot. Voters can choose from among all registered candidates and write-ins are counted. There are two types of primaries, closed and open. In a closed primary, voters may vote only in the primary of the political party in which they are registered. In an open primary, the registered voters are allowed to vote in the primary of any party but they can only vote in one primary.
Furthermore, prior registration enables registered voters of each party to decide which candidate they want to run in the elections. For example, for the North Nazimabad constituency of Karachi, MQM has 500,000 registered voters; and MQM has three individuals who are in line to be given the party ticket to stand for elections for that seat. However, in this scenario, instead of the party choosing the representative, those 500,000 voters will have a mini internal election, in which the 3 candidates will run against each other; and the winner of that mini election will then participate in the main election from MQMâs platform.
This will bring a democratic culture within parties and result in voter engagement. The mini internal election will also serve as a precursor of the main elections; and give the voters a glimpse of their candidates; their strong and weak points; their goals and agendas; etc. This would be made possible through the âprimariesâ. The direct primary or preliminary internal election would pit candidates against each other, who would compete to win utmost votersâ confidence and secure the maximum number of votes, not just in the mini election or internal party primaries, but also in the main election against candidates of opposition parties.
AUTOMATED VOTING PROCESS:
in voting lists; there are no [area-based] duplication in names of voters; and rigging is minimal. A clear and concise process needs to be developed for the creation of either the software that ensures this; or an application that completes the task. Humans based systems are vulnerable and often targeted by miscreants for foul play.
In order to ensure rigging-free elections, there should be a mandatory audit of 40% of random voting centers or polling stations/booth.
A channel like âC-Spanâ (in the US) must be formed that covers all political activities 24/7. It should be under a government department, in form of a public watch-dog or not-for-profit entity that does video coverage of all level of activities in the electoral process. There would be live debates between candidates posted online or broadcasted on television allowing everyone and anyone to assess the candidates, review their performances and make decisions to vote for or against them based on that evaluation.
Parameters based performance will be promoted. This entails that parameters will be developed for MNAs & MPAs (such as roads developed, hospitals refurbished, health unitsâ set-up, schools built or made functional, etc.) and their performance will be matched against those parameters. This will allow voters to review the performance of their representative in light of those parameters; and enable them to gauge whether their term has been beneficial for them, the community and the constituency.
Automated Removal Process would be developed for the elimination of incompetent players. At a pre-determined time interval, ideally on an annual basis, the voters will have the option of voting out their elected representative if they think s/he hasnât delivered on their promises (in light of the parameters â which will serve as a gauge for performance.)
If a simple majority or 51% of the total voters who voted in any given constituency (not just for the winning candidate, but the total votes cast) vote for the removal of an elected representative, then his tenure will be terminated. A one-month time window will be automatically activated at the time of the 1st anniversary of the representativeâs tenure; and if 51% of voters desire him to leave during that one-month period, then there will be termination of tenure; and new elections held for the selection of a new representative.

'Establish democracy at the grass roots level' OBJECTIVE & PURPOSE:
Committees in the Senate and Parliament essentially seek to safeguard the rights of the common man who is rarely present in government offices. They serve as the eyes and ears of the common man when they function with integrity, and strive to serve the national interest.
The proposed legislation would keep strict checks on all government bodies and officials and make sure that each one serves the people of Pakistan in the best possible manner.
There should be numerous Parliament / Senate committees working effectively, efficiently and expeditiously to monitor various plans of the government. Regular election of committee should be conducted on a timely basis. Furthermore, the committees must be nonpartisan and nonaligned with any political bodies. They must remain objective and determined, and work towards a single goal of serving the nationâs best interest.
A centralized e- portal must be created that would serve as a database for all functioning committees. It would hold details of the current issues, future plans and goals, plus a weekly performance update of the Committees. Organizational charts would be provided on the e-portal for Committees and individual members in key positions, to help keep records of their performances.
Committees play an effective role in the smooth running of legislative bodies. Individuals who are members of such committees become aware of all the intricate workings and day to day operations of such bodies, and develop expert knowledge.
Committees are essentially fact finding, consensus building and policy recommending boards that seek to fulfill the demands of the citizens. Parliamentary committees form a link between the Parliament, the Executive and the general public. Although there are 44 committees in the Parliament at present, including standing, house, finance and functional committees, they are costly and inefficient and have failed to leave their mark in any way.
The committees through this proposed legislation will be authorized to sua sponte(take charge without formal prompting) expenditures, subordinate legislations, administration, public petitions and policies of the ministry concerned and its related public bodies. Through the legislation each working committee will be provided proper resources and expert knowledge to supervise the executive operations in the best possible manner. In addition, the committees will help the legislature in performing its duties and functions well and on time.
The legislation will become central to parliamentary democracy and allow its members to not just comment on the proposed laws and government policies, but also to thoroughly examine, research and question them.
The Committees of the two houses will only benefit if they form an effective and efficient accountability system for the Parliament unlike the present committees that are prone to taking sides, are dictated by ministers and lie under the control of the government. Once a powerful and independent Committees system is established, it will have a huge impact on the operations of democratic bodies and curb government atrocities and corruption.
Things will change with committees gaining insight into the operations of the Executives. Presently, the committees are misguided and left ignorant, because the Executives only want to give them information that favors them. However, a functioning committee under this legislation will become a useful tool for accumulating the right data and providing it to the public for scrutiny.
The right and resourceful committees under this legislation will nip corruption in the bud and create a system of accountability. Fruitful and beneficial projects and policies would be favored and encouraged whereas foolish and disastrous projects would be withdrawn. A system of checks would be kept on different departments and bodies and their projects would be kept under strict scrutiny.
A centralized e-portal will be created that will serve as a job listing site as well as a database of profiles and resumes of all those who have applied for any job. A good database will allow the system to identify individuals fit for specific jobs as well.
Meanwhile, the government will have to develop a standard test to ensure that each employee it hires meets a baseline criteria â not just in terms of literacy but also in terms of behavioral and attitudinal competencies. This will drastically improve the public sector work force.
Also, anyone and everyone can view this process. There should be a complete listing of all the jobs available; list of all candidates who have applied; list of candidates who have been successful; etc. This will mean that each candidate knows that they had a fair shot at the job; and also the stage where they failed. This will enable them to prepare better in the future.
This way, the process of hiring would also be under review and can thus be constantly improved through feedback. The entire hiring process will also be charted on the e-portal, with candidates able to find out the number of stages after which the hiring decision would be made, and the time-frame for each part of the hiring process. This will ensure that each department executes its hiring process with due diligence; otherwise, it could be held accountable for failing to execute the process in the defined time-span.
The proposed legislation would aim to bring uniformity in various education systems operational in the country, through listing compulsory subjects that all students would have to study at different levels and in different fields, from 3rd grade up to university level.
The choice of subject, curriculum and educational content would be decided on by a team of local and foreign education experts in the related fields. The team of experts would be asked to include character building content in the academic courses for inculcating moral values and strong ethical sense in the youth.
Another important aspect of revolutionizing the educational system of the country is to shift focus from the memorization culture to the understanding of basics, creativity, accomplishment and the capability to give back.
A baseline test would be created for primary, secondary, intermediate and university students, which would be compulsory for all in addition to the regular school exams. This would ensure that all students at different levels of schooling meet a certain set standard, nationwide.
Specific attention will be given to rural and less developed areas, where special classes will be conducted to ensure that students have the required training to sit for that particular test.
The results of the tests will also show not just the level of literacy in different areas of Pakistan but also the nature of literacy in each area. For instance, if a college student from a remote village in Baluchistan is incapable of clearing the standardized test for secondary school, then it would clearly illustrate that the level of education in that area requires improvement.
Tutorials, audio and visual guides, and coaching and training facilities would be provided to students belonging to remote areas. The test results would also highlight the areas where such training is necessary or requires improvement.
The government can approach various voluntary teaching programs operating in Pakistan for recruiting qualified teachers. Another option is making â3 to 6 monthsâ of practical education in form of âteaching internship/assignmentâ in rural areas, mandatory for graduate degree students. Classroom instruction or teaching a term in school can also be made an essential part of the graduate degree programs, in order to facilitate education in all parts of the country.
In order to encourage a learning culture across the country, the government must award scholarships annually from a bigger platform. Rewards awarded to exceptional students by the state must be publicized and posted on government portals. This would not just bring the brilliant minds of the country into the limelight but would also inspire the younger lot to strive harder.
Each public sector organization and department will have to set goals, aligned with the overall vision of the nation, and have their performances reviewed against those goals.
A similar principle will be applied to departmental heads and government personnel using basic performance parameters such as departmental, team and individual goals set and achieved; number of hours spent at work; major tasks performed; etc. Employees (from a certain grade upward) will be required to define their yearly & quarterly goals.
All employees will have to enter their daily check-in and check-out time; so that everyone can see how many hours they put in at work; they will also submit a daily report of activities, or it can be weekly or monthly depending upon the nature of work and designation. However, irrespective of designation, government servants must carry this out â whether itâs the MD of PIA or Pak Steel or a lowly clerk in the City District Government Karachi.
Requisite working hours would have to be calculated for senators, legislators and members of Standing committees and the mentioned dignitaries will have to put in the required working hours in their offices. Plus they will have to post details of their performance, history and achievements as well.
Organizational chart will be made available on the portal for this purpose.
In addition, all government employees will essentially have annual training. Plus, they will have to sit for annual examination relative to their work, to ensure that they are abreast with the latest developments, and continue to work effectively. This will make the system merit-based in effect, as the exam results will provide a gauge of the employeesâ abilities.
Creation of a centralized National Problem Resolution Centre (NPRC), run on the basis of public-private partnership, where citizens can register their complaints, problems and grievances as well as provide feedback on every sphere of issue that falls under the scope of governance.
The NPRC would be given access to ensure that the complaint reaches its destination (department, personnel, etc.) and the authority to follow-up on action, to remedy the problem within an adequate time-frame. It would also record the details of complaints lodged and problems resolved, at an individual and collective level, giving a snapshot of the performance of a whole range of government departments.
The solution centre, with its access to government departments, public sector organizations (utilities, municipalities, etc.), elected representatives, etc. will operate as the central issue resolution centre for all citizens of the state. It will connect all state organs and relevant departments as well as incorporate semi-autonomous and private entities in its sphere of work.
The legislation will create and empower an electronically centralized issue resolution centre, allowing citizens from any corner of Pakistan or even abroad to register their complaints and voice their concerns about all matters of the state, governance and everyday life.
As the information will be available and accessible through a website, each department could be held accountable for the lapse in its performance and delay in resolving problems. Thus, a system of checks and balances will be created that would automatically eradicate half the problems of inefficiency rife at various levels of the government.

The listing of all government tenders and procurement drives by various departments of government entities, whether ministries or offices, on the e-portal will ensure that everyone has access to the details of the tender in its entirety.
The exact details, requirements and TOR (terms of reference), etc. should be made available on the e-portal. This will also make the tender accessible to a wider number of bidders.
This will provide an archive of all tenders and procurements issued by the government; and enable the public and relevant accountability committees to do random checks of tenders and bidding processes, as well as those with successful tenders and otherwise.
Thus, the possibility of malpractice, embezzlement, price manipulation, etc. can be reduced by the threat of random checks of successful and failed tender bids.
Furthermore, once the archives have been established, with regular biddings on tenders and procurements, identifiable patterns will emerge in terms of companies that are successful in gaining government tenders, as well as those that continually make bids for such projects. This will enable more in-depth analysis and coverage of successful companies, and investigation into any possible ties or connections with those awarding the bids. This will serve as another method through which long established malpractices will be threatened, if not rooted out.
The purpose of this legislation is to ensure that tender and procurements policies are based on the principles of value, accountability, probity and transparency. Fair and nationwide opportunities for participating in the government process of nation building, through listing of government tenders aâŚ
This legislation will bring the process of devolution truly into play. Intra-party democratization will be introduced for ingraining the values of democratic principles, within the functionaries of any given political party. The problems of nepotism, cronyism and favoritism that mar most political parties and political process overall would be changed in due course. By means of this process individuals who donât possess the requisite qualities to govern will be whetted out whereas; a merit based system will ensure that the best and the brightest minds rise to the top of the party hierarchy.
This will have a direct bearing on the improvement in governance and will make people feel more part of the electoral process. Also, with the representative or individual running for election coming from among the masses, the individual is likely to have a much greater understanding of the problems faced by the common man and his lot, and would be able to solve them better.
It will also be a clarion call for the younger generation, which is around 80-100 million, that they can join politics, and that they can have a future in it, irrespective of the political connections, family lineage, patronage, etc. that are currently considered pre-requisites for being able to reach the top at any level in any political party, and to stand for elections from the party platform.
Moreover, the party also needs to introduce a certain percentage as a quota for professionals as party candidates. For instance, 10% of academics, 5% of business leaders, entrepreneurs, etc, should also be made, so that people with the right qualification and acumen join political parties, and know that they have a real chance of being in a position where they can promt change.
The idea behind issuing a quota for professionals is to bring more management, methodology and organization to political parties, which are often run in an ad hoc manner. The introduction of this quota will quickly show its benefits, and political parties will realize that the induction of such professionals is to their benefit.
Furthermore, such professionals, with years of experience, will also be adept at policy making, and thinking long-term, rather than short-term, which is the need of the hour.
PRINCIPLE CONCEPT: Revival of the political process. 'Why not the Best?'
The bill will identify, suggest & present certain basic parameters that will focus on the fundamental themes of development & social welfare: health, education, livelihood, housing & infrastructure and the state of the environment.
The elected representative of the area will have to provide & report numerical data on these five themes. These parameters will be similar to those used by welfare states and development agencies to assess living conditions in any society. For instance, the parameters used to develop the Human Development Index, which was the brainchild of the famous Pakistani economist and former minister (late) Dr Mahbub-ul-Haque will be part of these parameters, along with those used by the United Nations to gauge societal standards, the Millennium Development Goals (MDGs) and various other similar bodies.
The data will be uploaded on the (same) e-portal & will serve as a tracker of social & societal development in the various constituencies across the country. As this information will be freely available and easily accessible, it will provide not only a snapshot of the social indices of any particular region in Pakistan, but also provide the people of a particular constituency to hold their leader accountable , incase the said region performs poorly as per these social & societal indicators.
As mentioned earlier, the parameters will be developed from the five basic issues that most of the developed world is faced with: Health, Education, Livelihood, Housing, Infrastructure and Environment
The other purpose is to assess the Law and Order situation of any given area; and personnel of Law Enforcement Agencies (LEAs) will be required to perform similar functions of logging in reports based on pre-defined parameters.
The responsibility of reportage will range from the top-tier of police personnel, the Inspector General (IG) of Police, and go right down to those who interact with complainants on a regular basis, such as Station House Officer (SHO), Sub-Inspectors (SI), Assistant Sub-Inspectors (ASI), Superintendents of Police (SP) & their assistants, or ASPs.
The e-portal will also have a section for the women police department, who would be required to submit reports with similar frequency.

To make available details (either estimations or exact figures) of total budgetary allocations available to the Federal and Provincial governments, and to the ministries that fall within their jurisdiction. Also, to document and invoice all expenses and financial transactions carried out by each branch of the government, irrespective of the size of the outlay of the expense.
The core purpose of this legislation is to make available all financial details of the government on an e-portal in a transparent manner. The details will be made accessible to everyone, most importantly, the tax-payer, who pays for these financial transactions and has the right to know how his/her hard-earned money is spent.
