Ida County Commences Legal Action Challenging Iowa Department of Management Decision

IDA GROVE, Iowa — Ida County has filed a Petition for Judicial Review in Iowa District Court challenging a decision by the Iowa Department of Management (DOM) regarding the County’s voter-approved Emergency Medical Services (EMS) levy.

The lawsuit asks the court to determine whether the Department of Management exceeded its legal authority by reducing Ida County’s certified EMS levy rate following the enactment of Senate File 2496.

In 2023, Ida County voters overwhelmingly approved a countywide EMS levy to provide stable, long-term funding for emergency medical services. The measure passed with approximately 78% voter approval, demonstrating strong public support for maintaining and improving local ambulance services.

Following the passage of Senate File 2496, which changed how tax increment financing (TIF) property is treated for certain levies, the Department of Management reduced Ida County’s certified EMS levy rate. Ida County believes that action is inconsistent with Iowa law and improperly limits the levy approved by local voters.

“The people of Ida County voted to authorize an EMS levy of up to 75 cents per $1,000 of taxable valuation,” said County EMS Director Corey Trucke. “This case is about ensuring that voter-approved local decisions are respected and that state agencies operate within the authority granted to them by the Legislature.”

“The needs are obvious. Ambulances cost $250,000 or more. Cardiac monitors are $75,000. We have several of these items in the county that need replaced now or very soon.”

The County is not challenging the TIF reform enacted by the Iowa Legislature. Rather, the lawsuit seeks judicial clarification regarding whether the Department of Management had the statutory authority to reduce a voter-approved levy without legislative authorization.

Ida County remains committed to providing high-quality emergency medical services while responsibly managing taxpayer resources. County officials believe obtaining judicial guidance will provide clarity not only for Ida County but also for other Iowa counties affected by the Department’s interpretation of the law.

The filing of the lawsuit does not immediately impact the day-to-day operation of Ida County EMS. Emergency medical services will continue uninterrupted throughout the legal process.

Because the matter is now pending before the court, County officials will have limited comment regarding the specifics of the litigation but will provide updates as appropriate.

🚑 Congratulations to Our Newest EMT! 🚑

It has been awhile since we posted about a new EMT. We are proud to announce that Crysta Hupke has successfully passed her National Registry of Emergency Medical Technicians (NREMT) exam and is now a certified EMT!

This is not an easy task and takes a lot of hard work and time. We appreciate her willingness to join our service and wanting to serve her community! THANK YOU for taking the time to reach this goal! We are so proud of you!!
