Just in case you were wondering about the “small” house being built on 301 Lakefront. Here are the plans. There are more detailed plans that were submitted I think earlier this year. But the footprint is the same. Request a FOIL for approvals of the building permits and copies of the permits. Notice that the permit recently approved does NOT have the conditions that were included with the original planning by board approval or building permit. Request reason why conditions were removed? That was wrong. Ask for documentation of all meetings regarding the approval of the giving away of public property when house plans and building permits approved building a structure on top of Town road/ right of way known as LakeFront running east to west across 301 LakeFront. Ask for approval meeting notes to raise the height restrictions to 30 feet along loomed bordering the lake. Yes Keri Ivers did this and made it retroactive because the owners design was 27 feet elevation, exceeding the code maximum of 25 feet. Oh and by the way she made it retroactive. Your current supervisor John Perticone knows all about these abuses of power when he sat on the Town Board and did NOTHING . So write, call and get this to stop. The Town is responsible for approving the plans and building permits.

Keep these screen shots with you on your phone in case the Lake neighbors tell you to leave “their beach”. 15 feet from the high water mark. That is the public area of the beaches that are in Irondequoit. Access is private except through Bateau unless you have it in your deed

It’s that time of year when residents of Summerville want to use the beach, and some lake owners are confused as to whether they own the beach and can restrict use. Here is the rules. Town property is 15 feet from the high water mark. People are allowed to use the beach as long as you follow the rules. IPD knows that the Town property is 15 feet from y to he high water mark. If you need to copy the rules onto your phone if residents are confused and try to kick you out, I will post them here

I know a lot of you might be wondering how is the owner of 301 Lakefront able to build over the path and on the property. I’m going to lay out for you 7 years of fighting this. The Town of Irondequoit did abuse their authorized power in approving a plan that essentially gives away public property ( a portion of Lake Front-an established walkway/road on the zoning map) without following the process of the NYS Constitution. This was abuse of power by Supervisor Seeley, Supervisor Evan’s, the Planning Board, Kerry Ivers, and now Supervisor Perticone. I testified about this is 2020. I wrote numerous emails to all of them including the Town Board. I brought a complaint with the NYS Attorney General last year citing abuse of power of the individuals above and nothing happened. Nothing! So I site snd wait until we all suffer damages and then sue the Town for damages. Our lawsuit was dismissed in part because we did not suffer any damages. And the Town was not a party to the Action.

What upsets me is the ability for each of the Town leaders to look the other way, actually change maps and height restrictions, making them retroactive just so this guy could build his house in that location.

Mind you, none of us were opposed to him building a home in the lot, but to respect the boundaries and easements. He didn’t need to build 27 foot elevation with 2 stories and 3 car garage, when he deceived our neighbors into thinking he was building a 1200 sq Ft cottage. Even now he continues to deceive with his application for building permit that was approved under Evan’s and now Perticone for the same huge footprint, but approving a building permit for just the 1st floor sq footage ( and saying the 2nd floor with the beautiful windows overlooking the lake will be left unfinished. Ok, right. Since we have exhausted funds fighting this, including slot of my own money, all that I can suggest is request a FOIL to show the approved building permit and plans and any and all documents showing that the Town followed the NYS Constitution process in giving away public property to an individual through approving plans and building permit to build a structure right on top of it.
