From the page creator: I was able to remove one admin, but I am unable to remove another due to technical issues with the page or so its showing on my end for awhile now. This situation has become frustrating, and I want to make it clear that I do not wish to be involved in any drama.

This page was originally created as a space for people to share their outings at Southfork Elk View through photos, videos, and posts about their days, wIth that being atv rides, camping, hiking, scenic and images of the animals around and so on. For discussions or debates about the horses there are other pages just for them and those types of post and comments.

As I have mentioned before, I was unaware of the extent of the drama occurring on this page until it was brought to my attention, as I did not receive notifications and had entrusted the admins to manage it, im not aware of what all has been said or deleted over time, I do want to thank them for their time and the content they shared over the years.

Given the current issues with admin controls issues, I may need to delete this page soon.

Also Thanks to all who have followed this page over the years, I'm sorry it went in the direction that it has and no hard feelings towards anyone.

Message from the Creator of this Page:

I created this page many years ago as a place for people to share their beautiful photos, videos, and the fun they experienced while visiting Southfork Elk View. Over time, I added a few admins to help manage the page and promote the area. Although I moved away some time ago, Southfork Elk View still holds a special place in my heart as I am from Breathitt and was at Elk View quitr often.

Recently, it was brought to my attention that there have been disagreements and posts shared here that do not align with the original purpose of this page. Unfortunately, I was unaware of this due to page notifications being lost among my other pages.

This page was always meant to be a positive space celebrating tourism and the natural beauty of Southfork Elk View. While I understand there has been discussion about the horses — which I also deeply care about — there are other dedicated pages where those specific topics and concerns can be shared and discussed more appropriately.

Moving forward, I’d like your input on how to best guide this page back to its intended purpose:
1. Should the current admins remain but follow stricter posting guidelines?
2. Or should I remove the current admins and bring on new ones?
3. Give me an idea.

I sincerely apologize that this page has strayed from its original vision and do not tolerate arguments and so. My goal has always been to create a welcoming and uplifting place to share the beauty and joy of Southfork Elk View.

Thank you all for understanding and for continuing to be part of this community. Other than the arguments, I thank the admins for the positive post that had been shared over time as well.

𝗔𝗧𝗧𝗘𝗡𝗧𝗜𝗢𝗡 all concerned citizens, landowners, and individuals involved in horse removal efforts:

The recent actions of the Breathitt County Fiscal Court with regard to their removal campaign of all free roaming horses have raised many questions about the legal process for the removal of these horses. We want to provide important clarity on this issue to help protect everyone involved.

Based on online research and an analysis of Kentucky law, 𝙖 𝙘𝙤𝙪𝙣𝙩𝙮 𝙛𝙞𝙨𝙘𝙖𝙡 𝙘𝙤𝙪𝙧𝙩 𝙙𝙤𝙚𝙨 𝙉𝙊𝙏 𝙝𝙖𝙫𝙚 𝙩𝙝𝙚 𝙡𝙚𝙜𝙖𝙡 𝙖𝙪𝙩𝙝𝙤𝙧𝙞𝙩𝙮 𝙩𝙤 𝙞𝙨𝙨𝙪𝙚 𝙖 𝙜𝙚𝙣𝙚𝙧𝙖𝙡 𝙤𝙧𝙙𝙚𝙧 𝙛𝙤𝙧 𝙩𝙝𝙚 𝙥𝙪𝙗𝙡𝙞𝙘 𝙩𝙤 𝙧𝙚𝙢𝙤𝙫𝙚 𝙨𝙩𝙧𝙖𝙮 𝙖𝙣𝙞𝙢𝙖𝙡𝙨 𝙛𝙧𝙤𝙢 𝙥𝙧𝙞𝙫𝙖𝙩𝙚 𝙥𝙧𝙤𝙥𝙚𝙧𝙩𝙮.

𝗛𝗲𝗿𝗲 𝗶𝘀 𝘄𝗵𝗮𝘁 𝘆𝗼𝘂 𝗻𝗲𝗲𝗱 𝘁𝗼 𝗸𝗻𝗼𝘄:
A Fiscal Court Vote is 𝙉𝙊𝙏 a Court Order from a Judge: A vote by the fiscal court is a legislative or administrative act. It is 𝙉𝙊𝙏 a judicial court order from a judge. A fiscal court, including a County Judge/Executive, cannot override a private citizen's fundamental right to property. For an order to legally compel the removal of horses from private land, it must come from a judicial judge after a formal legal process.

𝐓𝐡𝐞 "𝐓𝐚𝐤𝐞𝐫-𝐔𝐩" 𝐏𝐫𝐨𝐜𝐞𝐬𝐬 𝐢𝐬 𝐒𝐩𝐞𝐜𝐢𝐟𝐢𝐜: Kentucky Law (𝐊𝐑𝐒 𝟐𝟓𝟗.𝟏𝟐𝟎) outlines a very specific process for a person to legally "take up" a stray animal. This process is intended for individual citizens and does 𝙉𝙊𝙏 grant the county the authority to organize or direct a mass removal operation on private land.

𝐓𝐡𝐞 "𝐓𝐚𝐤𝐞𝐫-𝐔𝐩" 𝐏𝐫𝐨𝐜𝐞𝐬𝐬 𝐢𝐬 𝐒𝐩𝐞𝐜𝐢𝐟𝐢𝐜: If you have already removed a horse, you may still be charged with 𝐜𝐫𝐢𝐦𝐢𝐧𝐚𝐥 trespass entering private property to remove the horse(s) without landowner permission. A landowner has up to five years to file a 𝐜𝐢𝐯𝐢𝐥 lawsuit for trespass. Furthermore, anyone who unlawfully takes control of another's movable property can be criminally charged with theft by unlawful taking. 𝙏𝙝𝙚 𝙡𝙚𝙜𝙖𝙡 𝙥𝙧𝙤𝙩𝙚𝙘𝙩𝙞𝙤𝙣 𝙤𝙛 𝙩𝙝𝙚 "𝙩𝙖𝙠𝙚𝙧-𝙪𝙥" 𝙥𝙧𝙤𝙘𝙚𝙨𝙨 𝙤𝙣𝙡𝙮 𝙖𝙥𝙥𝙡𝙞𝙚𝙨 𝙞𝙛 𝙩𝙝𝙚 𝙝𝙤𝙧𝙨𝙚 𝙬𝙖𝙨 𝙩𝙖𝙠𝙚𝙣 𝙡𝙖𝙬𝙛𝙪𝙡𝙡𝙮. 𝗧𝗵𝗲 "𝗧𝗮𝗸𝗲𝗿-𝗨𝗽𝗽𝗲𝗿" 𝗙𝗼𝗿𝗺 𝗮𝘀 𝗘𝘃𝗶𝗱𝗲𝗻𝗰𝗲: The form you filled out to "take up" the animal MAY be used as legal evidence against you. This document could serve as an ADMISSION that you were involved in the removal of an animal, and prosecutors or a civil plaintiff could use it to prove that you knowingly entered private property to do so and potentially committed THEFT.

𝗧𝗵𝗶𝘀 𝘀𝗶𝘁𝘂𝗮𝘁𝗶𝗼𝗻 𝗰𝗮𝗿𝗿𝗶𝗲𝘀 𝘀𝗶𝗴𝗻𝗶𝗳𝗶𝗰𝗮𝗻𝘁 𝗿𝗶𝘀𝗸𝘀 𝗳𝗼𝗿 𝗲𝘃𝗲𝗿𝘆𝗼𝗻𝗲. The county, its officials, and especially the Animal Control Officer (ACO) personally, could face 𝐜𝐢𝐯𝐢𝐥 lawsuits for negligence and even 𝐜𝐫𝐢𝐦𝐢𝐧𝐚𝐥 charges for WANTON ENDANGERMENT or OFFICIAL MISCONDUCT.
