**UPDATE ON VA RULING**

As of February 27, 2026 the interim ruling has been OFFICIALLY RESCINDED from the Federal Register! This is a HUGE win for veterans. This was only made possible because we made all our voices heard. Below is the official rescinding document in the CFR.

As of yesterday, Secretary of the VA Doug Collins posted on Facebook that "VA is halting enforcement of the interim final rule, Evaluative Rating: Impact of Medication."

This statement of halting does not change the fact that the ruling is still live in the Federal Register (which is the law). The new ruling HAS NOT been rescinded.

There is a lot of question regarding the VA's new interim ruling RIN 2900-AS49. Here is the deal.

Basically what it is saying is that the VA is going to take your condition and rate it based off of the medication or help you are receiving. For example: If your hearing loss is at 40% without a hearing aid, but with a hearing aid it is 10%, they will rate at the 10% level.

Specifically from the ruling:
Specifically, this amendment clarifies that veterans should be compensated for the actual level of functional impairment they experience and, therefore, that the ameliorative effects of medication should not be estimated or discounted when evaluating the severity of a veteran's disability at the time of the disability examination.

The stance of our office is that we are against this new ruling as we feel the unintended negative consequences on veterans would be great.
