The Penn Forest Township Zoning Hearing Board has set a date for the continuance of the hearing for Mele Brothers Substantive Validity Challenge to the Zoning Ordinance. The hearing will begin at 6:30 p.m. on Tuesday, September 29, 2026 at the Penn Forest Twp. Vol. Fire Co. #1.

The Penn Forest Township Zoning Board will reconvene the J. William Fontaine hearing on Tuesday, September 1, 2026 at 6:30 p.m. at Penns Peak, 325 Maury Road, Jim Thorpe, PA 18229. This is a continuation from the first night of testimony on the Substantive Validity Challenge against the Township Zoning Ordinance.

At the June 24, 2026 hearing regarding the Substantive Validity Challenge to the new zoning ordinance by William John Fontaine, the Penn Forest Township Zoning Hearing Board granted a continuance to be held on Monday, August 17, 2026 at 6:30 p.m. at Penns Peak, 325 Maury Road, Jim Thorpe, PA 18229.

The Penn Forest Township Zoning Hearing Board has two (2) open positions as alternate members for the Board. The term of appointment is three (3) years. An alternate member should be familiar with the neighborhoods in the township and have a general knowledge of the municipality’s structure, but may not be an employee of, nor hold a position on any other board or commission in the municipality. Alternates are encouraged to attend regularly scheduled meetings, and any hearings that may come before the Board.
Interested parties shall submit a letter of interest, outlining their skills and background and highlight relevant experience, to the attention of the Penn Forest Township Board of Supervisors, 2010 State Route 903, Jim Thorpe, PA 18229.
Deadline is August 21, 2026.

NOTICE IS HEREBY GIVEN THAT there will be a hearing on August 6, 2026 at 6:30 p.m. at the Penn Forest Township Municipal Building at 2010 State Route 903, Jim Thorpe, PA 18229 to hear the request of Riley Rager, 1050 Main Street, Pennsburg, PA 18073 for property located at 693 State Route 903, Jim Thorpe, PA 18229, owned by Shaun P. McElmoyle, 1125 Center Street, Jim Thorpe, PA 18229, Tax ID 67-51-A28, for relief from section 240-58-B.(6) of the Penn Forest Township Zoning Ordinance.
Appellant seeks to remove the existing 64 sq. ft. freestanding sign and construct a new 49 sq. ft. sign to the right of where the existing is located, approximately 8 feet from the property line of 701 SR-903.

NOTICE IS HEREBY GIVEN THAT there will be a Meeting of the Penn Forest Township Zoning Hearing Board on July 30, 2026 at 6:30 P.M. at the Penn Forest Township Volunteer Fire Company #1, 1387 PA-903, Jim Thorpe, PA 18229, to hear the following:

Challenger is Plainfield Solar, LLC, represented by Shawn N. Gallagher and Buchanan Ingersoll & Rooney PC designate of property owner Queen of Peace Missionary Associates, Inc., property at O North Meckesville Rd, Albrightsville, Pa 18210, tax parcel ID 2-51-A5, and property owned by Lynx Associates, LTD identified as tax parcel 10-51-A7.01, who files a substantive validity challenge to the Zoning Ordinance as it relates to the solar energy use. Challenger states that the zoning ordinance and map do not provide for its fair share of this use, the zoning ordinance is unconstitutionally exclusionary and that the applicant is entitled to site specific relief.

Chairman Comments:
Parties with standing and those that have previously entered an appearance will be allowed time to present and cross examine other witnesses. This is a hearing, following protocol much as a courtroom proceeding. This is not an open forum public meeting, and attendees are expected to condut themselves accordingly.
Public comment will be afforded at the end of all testimony and the record closed, and will be limited to three (3) minutes per person. If additional dates to conduct the hearing are required, they will be scheduled within the paramaters allowed by the Municipalities Planning Code, at the convenience of the parties to the hearing.

The Substantive Validity Challenge for Culp/Keller scheduled for Wednesday, July 29, 2026 has been withdrawn by the challengers.
The Zoning Hearing Board accepts this withdrawal as submitted and considers this matter closed.
