Courts may recognize and protect opinions expressed on social
media under the First Amendment. The Town of Kennebunk will ensure that social media content complies with all applicable laws, regulations, and policies, including:
o Guidelines for information management and public records retention. o Protection of legally restricted content, such as copyrighted or trademarked material. The Town of Kennebunk’s policy on unacceptable comments that may be restricted includes comment(s) that:
o Promote hate or hate speech;
o Promote violence;
o Contain threatening language;
o Are obscene;
o Discuss or encourage illegal activity;
o Promote, foster, or perpetuate discrimination based on creed, color, age, religion, gender, marital status, status regarding public assistance, national origin, physical or mental disability, or sexual orientation and violate Town harassment, bullying, and discrimination policies;
o Contain defamation or libel;
o Share information that could compromise public safety or security;
o Violate legal ownership rights (e.g., copyright laws);
o Contain sexual content or links to sexual content;
o Contain unsolicited commercial promotions, advertisements, or spam that are not relevant to the discussion.
