Here’s the clean, operational breakdown of how “No Tax on Overtime” actually works, based on the latest details from the 2025–2028 federal deduction.

How “No Tax on Overtime” Works (2025–2028)

This isn’t a full exemption of all overtime pay.
It’s a federal tax deduction that lets eligible workers deduct the overtime premium portion of their pay — the “half‑time” part of time‑and‑a‑half.

So if you earn 1.5Ă— your hourly rate for OT, only the extra 0.5Ă— is deductible.

What Counts as Deductible

✔️ Eligible

• Only the FLSA‑mandated overtime premium (the extra 50% for hours >40/week)

• Applies to W‑2 employees with valid Social Security numbers Jackson Hewitt

❌ Not Eligible

• The base hourly portion of overtime
• Daily overtime (e.g., after 8 hours/day)
• Shift differentials, bonuses, hazard pay, or union premiums not tied to federal OT rules

• Married filing separately filers

Example:

• Regular rate: $25/hr
• OT rate: $37.50/hr
• Premium portion: $12.50/hr
