FRIENDLY REMINDER FROM THE JUDGE ADVOCATE GENERAL'S OFFICE: Even though the state laws will change in July in Nevada, Guardsmen are not authorized to use majijuana. All personnel in the Nevada Army National Guard are subject to the provisions set forth in Army Regulation 600-85. The Defense Secretary states, “Drug use is incompatible with DoD military and public service.” and the Federal Controlled Substances Act (21 U.S.C. 801 – 971) makes ma*****na use illegal. State law does not supercede federal law. The Intelligence Reform and Terrorism Pre-vention Act (50 U.S.C. 3343) prohibits federal agencies from granting or re-newing a clearance to an unlawful user of a controlled substance or an ad-dict, and under federal law, use of ma*****na remains unlawful. Executive Order 12564 mandates a drug-free workplace and expressly states that use of illegal drugs on- or off-duty by federal employees in positions with access to sensitive information is inconsistent with the trust placed in such employ-ees as servants of the public. All military service members are, for these purposes, federal employees. Changes in Nevada state laws pertaining to the use, sale, or manufacture of ma*****na remains adjudicatively relevant in national security determinations. Service members may be separated for ma*****na use and may also lose their security clearance due to ma*****na use.
