Marsy's Law for All

Marsy's Law for All Marsy’s Law is dedicated to the cause of ensuring that crime victims’ rights are codified in law throughout the United States.

Marsy’s Law seeks to give crime victims meaningful and enforceable constitutional rights equal to the rights of the accused. Some examples of the types of rights to which we believe all victims are entitled are:

- To be treated with dignity and respect throughout criminal justice proceedings
- To be notified of his, her, or their rights as a victim of crime
- To be notified of specific public pro

ceedings throughout the criminal justice
process and to be present and heard during those proceedings

"At its core, Marsy’s Law is about protecting victims and ensuring their voices are heard. But it’s also about something bigger: creating a justice system that helps prevent future harm by empowering those most affected."

Voters will consider a constitutional amendment in 2026.

A South Dakota Supreme Court decision reinforced an important principle: crime victims have constitutional rights that must be taken seriously. In this case, the court protected a victim’s privacy by rejecting an overly broad request for personal journals, affirming that victims have the right to challenge decisions and enforce their rights in court.

This is exactly why Marsy’s Law matters. It ensures victims are not treated as bystanders, but as participants with meaningful, enforceable rights. Read more below.

The case involved interpretation of the state’s constitutional amendment providing crime victims’ rights akin to those of criminal defendants.

Being a crime victim doesn't mean losing your voice. But for too long, the system has treated survivors like bystanders in their own cases: left out of hearings and plea deals, not even notified when a defendant is released. Marsy's Law changes that. It gives victims the constitutional right to be present, to be heard, and to be kept informed every step of the way. Because justice is for all.
