A Message From NARFE President Ken Thomas
Last week's senseless violence in Washington, D.C., is a stark reminder that the threads that hold our democracy together are fragile. NARFE condemns that violence, which took American lives and threatened the security of our elected officials and their staff. Federal workers were put in harm's way, directly or indirectly, as a result of this mob action.

While our country has survived division, turmoil, and strife, the return of such in the 21st century is astonishing and terrible. But we must move forward with the important business of government; by all measures, we should be navigating a peaceful transition of power.

I am certain our nation will endure, thanks to our steadfast, nonpartisan civil servants, who continue to fulfill their mission in these trying times.

Tell Your Representative to Cosponsor New WEP/GPO Repeal Bill

On January 4, Rep. Rodney Davis, R-IL, reintroduced the latest iteration of legislation to repeal the Windfall Elimination Provision (WEP) and Government Pension Offset (GPO). These provisions cut the earned Social Security benefits of federal retirees and their surviving spouses. The Social Security Fairness Act of 2021, H.R. 82, would fully repeal both provisions, which, together, affect over 2.5 million people nationwide.

OPM Issues Guidance on Higher Annual Leave Carryover Limit
The FY21 National Defense Authorization Act (NDAA) included a provision allowing certain federal employees to carry over an additional 25 percent of their annual leave into 2021. Typically, federal employees can carry over up to 240 hours of annual leave in a calendar year. The provision would allow most eligible employees to carry over 300 hours. READ MORE

On December 21, the House and Senate passed a $1.4 trillion omnibus bill and a $900 billion COVID-19 relief package in a combined vote, funding the government through fiscal year 2021 and providing a new round of aid to people and businesses. That bill now awaits signature by the president. Also, a seven-day stopgap funding bill was signed by the president to avoid a government shutdown. Passage of the omnibus and relief bill holds many implications for NARFE members and the federal community. Here’s a recap of the most notable provisions.

Congress Silent on Schedule F

Despite NARFE’s best efforts and those of our coalition partners, language blocking the implementation of Schedule F was not included in the omnibus spending package. NARFE is concerned the order has the potential to politicize the federal workforce and is disappointed that Congress failed to check this blatant threat to America’s merit-based civil service. We continue to keep the federal workforce and Congress informed of any implementation and will place pressure on the incoming administration to reverse any harm it causes. Thank you to all NARFE members who wrote their legislators in opposition. NARFE’s campaign was one of its most successful in terms of numbers of letters sent and congressional offices that received them.

New Round of Stimulus Checks

Congress approved another round of stimulus checks in the COVID-19 relief package. Individuals with up to $75,000 in adjusted gross income (AGI) on their 2019 tax returns will receive $600, and married couples with up to $150,000 in AGI in 2019 will receive $1,200. Those eligible for the payments with dependent children will receive an additional $600 for each child. The payment amount decreases by $5 for every $100 in income above the thresholds, phasing out completely at $87,000 in income for individuals, and $174,000 in income for married couples. Treasury Secretary Steve Mnuchin told CNBC that he anticipates the first payments will go out before the end of the year. However, it may take some time before all those eligible receive their payments.

1 Percent Federal Employee Pay Raise Expected

Barring any unforeseen circumstances, federal employees will receive a 1 percent pay raise beginning in January. The omnibus spending package was silent on federal employee compensation, deferring to the president’s alternative pay plan, which was transmitted in February 2020. That plan called for a 1 percent increase in base pay, with no adjustments to locality pay rates. Per NARFE conversations with executive branch staff, the president does not have the authority to reverse course on the 1 percent base pay raise.

Additional Time Granted to Pay Deferred Payroll Taxes

Congress included a provision in the omnibus spending package to extend the time in which federal employees must pay back deferred payroll taxes. Starting in September 2020 and continuing through the end of the year, federal employees making less than $104,000 per year had their Social Security payroll taxes deferred pursuant to a memorandum from President Trump. Those deferred taxes were set to be paid back, via payroll deduction, throughout the first four months of 2021. However, with passage of the omnibus, federal employees will now be able to pay back those taxes over the 12 months of 2021, via payroll deduction. This extended timespan will ease the financial burden placed on federal employees. Greater Flexibility for Flexible Spending Accounts Plans

The COVID-19 relief package includes a provision that permits flexible spending account (FSA) plans, such as health care and dependent care FSAs offered by FSAFEDS, to allow employees to carry over any unused amounts from 2020 into 2021, and from 2021 into 2022. NARFE is encouraging the Office of Personnel Management (OPM) to work with FSAFEDS to utilize this new authority to provide federal employees the option to carry over unused FSA balances. As the COVID-19 pandemic has resulted in unexpected circumstances regarding use of dependent care and health care, this expanded flexibility is a commonsense solution that should be available to federal employees.

$10 Billion to USPS

The CARES Act authorized the U.S. Treasury to extend up to $10 billion in borrowing authority to the U.S. Postal Service (USPS). The COVID-19 relief package converts the borrowing authority to a grant, meaning USPS will not have to pay back the amount. This will help ease the financial burden that the pandemic has placed on the Postal Service.

Cost of Living Adjustment (COLA)

Civil Service Retirement System (CSRS) and eligible Federal Employees Retirement System (FERS) retirees and survivors will be receiving a COLA effective December 1, 2020. The increase will be reflected in your January 2, 2021 payment. CSRS and FERS recipients will receive a 1.3% COLA.

Combined Federal Campaign (CFC)

Calling all Federal retirees! Are you looking for a way to make an impact in the community - or even around the world? The CFC allows you to continue your service and support the causes you care about. Transition your CFC pledge to your annuity during this year's campaign, September 21, 2020 - January 15, 2021 at https://www.opm.gov/showsomeloveCFC.

Electronic Annual Notice and 1099R

Why not start 2021 by receiving your annual mailer and 1099R electronically using your Services Online account. Simply log into www.servicesonline.opm.gov and enter your claim number, password and update your communication preferences in your Profile. If you have forgotten your password, it's easy to request another one, just follow the on-screen directions. If you have an email address associated with your account, a password will be sent to you or contact [email protected] to have a password sent to you.

Your annual mailer will be available for viewing in mid-December and your 1099R in mid to late January. You will receive a separate email from OPM informing you of when they are both available to view.

But deductibles and premiums for Medicare and FEHB plans often change yearly, and benefits like flexible spending accounts should be audited each year to fit your current needs. This may seem like a monumental task, and with hundreds of options, it would be nearly impossible to review all of this information annually on your own.

In October, the President signed an executive order (EO) which seeks to convert tens, or even hundreds, of thousands of federal jobs into a new Schedule F classification within the excepted service. These positions would be exempt from civil service rules and due process rights, which ensure federal employees are hired and fired based on their merit, not their political connections or lack thereof.

To prevent mass chaos during the presidential transition and ensure federal employees remain nonpartisan in their work, Congress must act immediately to block full implementation of the EO in its year-end spending legislation. READ MORE
White House Announces Support for 2021 Federal Pay Freeze
Click here to send a letter urging your legislators to reject efforts to freeze federal pay.

Last week, the White House reversed course on its initially proposed 1 percent federal pay raise, and instead endorsed Senate Republicans' proposal to freeze federal civilian pay in 2021. Appropriators in the House of Representatives, however, were silent on a 2021 pay raise, instead deferring authority to the White House.

The Senate's proposal comes alongside 11 other appropriations bills, intended to pass in an "omnibus" spending package. The House passed 10 out of 12 of their spending bills over the summer, largely along party lines. Congress has until December 11 to pass either a spending package that fully funds the government for FY21 or another continuing resolution (CR), potentially pushing permanent funding into the new Congress. At the time of this publication, congressional leaders were eying a week-long CR to buy themselves more time. READ MORE

Headquarters Telework Arrangement Continues Through March 31, 2021
Given continuing uncertainty about the coronavirus pandemic, NARFE Headquarters has extended its telework flexibility through the first quarter of 2021.

Our headquarters in Alexandria, VA, remains open for business. Most staff members are continuing to telework, and those who are coming into the office are following a staggered work schedule and mask-wearing/hand-washing mandates in accordance with CDC and Virginia Department of Health protocols regarding the transmission of COVID-19.
