Breaking News:

Mayor Mullen unilaterally, without public notice and without village board approval, entered into an agreement to release a $277,720 lien due and payable to Village of Lisle taxpayers & residents. P**f $277K gone.

The Mayor signed this agreement a full month after Burke, the former property owner and Jeep/Hummer dealer owner, had sold the property to a REIT for $11M. Yup, the lien was released a full month after the deed transfer. The lien was transferred with the deed if not repaid at that time.

** Does the Mayor have the authority to release $277K lien that are due and payable to Lisle taxpayers?
** Do the trustees even know about the $277K?
** How long till the village faces an lawsuit?

On Feb 20, 2013, the Village of Lisle recorded a lien against the property then known as the Hummer Dealership (currently leased to Tesla). Now that the property has been sold, repayment of the $277,720 lien is due!!

The lien was filed in the amount of $277,720.36 under Section 4.E(1) of that certain agreement between the Village and Naperyille Jeep Eagle, Inc., a Delaware corporation (*Owner-Operator'), dated October 7, 2002, and recorded in the Office of the DuPage County Recorder on October 24, 2002, as Document No. R2002-285164, a copy attached as Exhibit A and by this reference, made a part of this Notice of Lien (Economic Incentive Agreement").
This lien is recorded against the Property because of the Owner's breach of the terms of the Economic Incentive Agreement, and specifically the provisions under Section 4(C) that provides, in part:

".. if Jeep-Eagle (which term includes successors and assigns as set forth in Section 3.A. above) shall cease to do business at the Property or relocate a substantial portion of the Hummer franchise...then Jeep-Eagle shall be liable to reimburse the Village for the actual amount of taxes rebated to them pursuant to this Agreement."
