Lodi City Councilman to be sentenced for 14 counts of voter Fraud
San Joaquin, California: The sentencing phase of former Lodi City Councilman Shakir Khan is scheduled for January 26, 2026, Dept. 6d at 10 a.m. Superior Court, 180 East Weber Avenue, Stockton, California. Khan entered a guilty plea for 77 counts—41 charges of illegal gambling, money laundering, tax evasion, grand theft, 22 false claims filed to the Employment Development Department (EDD) regarding COVID-19 reimbursements, and 14 counts of election fraud.
Khan has yet to be sentenced for his “nolo contendere” plea to the 77 felony counts.
Khan asked to withdraw his guilty plea, which the judge will rule on at this hearing. If the judge does not accept the withdrawal of his plea, the judge may move forward with sentencing. Currently, Khan is out on bail and wearing an ankle bracelet.
Erin Haight, spokesperson for the San Joaquin County District Attorney’s office, said, “Khan must be present at the hearing.” Khan remains free, out on his own recognizance, and wears a GPS monitoring device, says Haight.
On October 13, 2025, Khan was scheduled to withdraw his “no contest” plea for the dozens of felonies he was charged with and instead petitioned the court for mental health diversion, according to his lawyer Allen Sawyer. That date was rescheduled for
January 26, 2026.
Days before the 2020 election, in which he would win the Lodi City Council District 4 seat, Khan was arrested on October 28. 2020, by the San Joaquin County Sheriff on suspicion of gambling, money laundering, and tax evasion. His arraignment would be a
year later, when additional charges were added.
In February 2023, Khan was arrested again, this time for voter fraud, all the while as a sitting council member. After his second arrest, then-Mayor Mikey Hothi visited Khan in jail and asked him to resign. He did so by signing a written letter, which Hothi immediately filed with the city clerk. Khan posted bond and has been out of jail since.
Khan resigned from his city council seat following his second arrest by the San Joaquin County Sheriff’s Department. He was also ordered to forfeit cash and property worth about $450,000, but all of that is said to be on hold pending the court’s decision
regarding Khan’s diversion request.
How can a convicted criminal, who willfully and wily defrauded American Voters to steal an honorable office via fraud, become too mentally 'incompetent' to pay the consequences for that crime?
This attempt by Kahn to withdraw his plea will signal to other criminals and fraudsters that they, too, can shirk the law and get away with stealing that most precious commodity. The trust of the American People in our government.
We strongly recommend that the court recognize the hard work and due diligence of the San Joaquin Sheriff's Department, the prosecutor's office, citizen researchers, and Kahn's OWN plea. Sentence him to a very merciful nine years in prison, and ban him
from serving in California politics ever again.
The nation needs an example that can be shown by San Joaquin County, that respect for the law must be for everyone, and most importantly for those who take the oath of office!!!
